RECOMMENDATION(S)

Recommendation

1.                     Ratify the execution of the Contractor Compliance Certification form, required by the California Department of Rehabilitation, for Revenue Contract Nos. 26-433, 26-434, and 26-435.

2.                     Authorize the Director or Assistant Director of the Workforce Development Department to execute, utilizing electronic or original signatures, and submit the following to the California Department of Rehabilitation for the contracts referenced in Recommendation No. 1, subject to review by County Counsel:

a.                     Any other additional supplemental documentation, such as Std 204 - Payee Data Record and contractor compliance certifications, required by the California Department of Rehabilitation.

b.                     Notice of termination in accordance with the termination provisions.

3.                     Direct the Director or Assistant Director of the Workforce Development Department to transmit the notices of termination, authorized under Recommendation No. 2, to the Clerk of the Board of Supervisors within 30 days of execution.

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost) and will not change the revenue, appropriation, or contract amounts previously approved by the Board of Supervisors (Board) for Revenue Contract Nos. 26-433, 26-434, and 26-435 (collectively “Revenue Contracts”).

 

BACKGROUND INFORMATION

The Workforce Development Department (WDD) operates the Workforce Innovation and Opportunity Act (WIOA) One-Stop delivery system on behalf of San Bernardino County. WIOA requires local workforce development boards to enter into Memorandums of Understanding (MOUs) with AJCC-required partners. Although the California Department of Rehabilitation (DOR) is an optional co-located partner, on May 20, 2025 (Item No. 92), the Board approved an MOU template which was executed with DOR on June 16, 2025. This MOU is in effect from July 1, 2025 through June 30, 2028, and establishes how the agencies collaborate to provide integrated services and share financial responsibility for operating the WIOA One-Stop System. The three Revenue Contracts, previously approved by the Board on June 9, 2026 (Item No. 100), authorize the DOR to reimburse the County for the shared space within the AJCC.

 

WDD is requesting ratification of the WDD Director's execution of the Contractor Compliance Certification form required by DOR for the three Revenue Contracts approved by the Board on June 9, 2026 (Item No. 100). Unfortunately, due to an administrative error, the June 9, 2026, Board Item No. 100 did not include authority for the WDD Director or Assistant Director to execute the Contractor Compliance Certification form, as well as other supplemental documentation, required by the State to accompany the Revenue Contracts. 

 

The Contractor Compliance Certification form certifies, under penalty of perjury, that the signor is authorized to bind the County to a number of clauses certifying compliance with specific enumerated State and Federal laws. The Contractor Compliance Certification form does not   modify the Board-approved Revenue Contracts.

 

The Contractor Compliance Certification form is required before the State can fully execute the Revenue Contracts. To avoid unnecessary delays in processing the Revenue Contracts, the WDD Director executed the Contractor Compliance Certification form to meet the State’s June 26, 2026 deadline. This item is being presented to ratify the Director's action and to delegate authority to execute any other additional supplemental documentation, such as Std 204 - Payee Data Record and contractor compliance certifications, required by DOR for the Revenue Contracts due to this authority not being included in Item No. 100 from June 9, 2026.
