Recommendation

Acting as the governing body of the San Bernardino County Fire Protection District, approve Amendment No. 1 to Contract No. 26-306 with Toneman Development Corp, increasing the total contract amount by $77,859, from $960,926 to $1,038,785, with no change to the construction completion date of 210 calendar days from the date of issuance of the Notice to Proceed (Four votes required).

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The Station No. 75 Butler Building Construction Project (Project) (WBSE 10.10.1618), with a total budget of $2,096,849 is funded through the San Bernardino County Fire Protection District’s (SBCFPD) Valley Regional Service Zone budget (5800752434). Sufficient appropriation for the Project is available in SBCFPD and the San Bernardino County Capital Improvement Program 2026-27 budgets and will be included in future budgets.

 

BACKGROUND INFORMATION

The Project consists of furnishing and installing a prefabricated metal storage building at Fire Station No. 75 in San Bernardino, serving the Muscoy community. The new structure will provide secure and weather protected storage for reserve apparatus and related equipment, reducing deterioration caused by environmental exposure and mitigating risks of tampering or theft. This improvement supports SBCFPD’s ongoing ability to deliver emergency services and maintain public safety in the Muscoy area.

 

On April 21, 2026 (Item No. 57), following Request for Proposal No. ANE223-ANE2C-6209, the Board of Directors awarded Construction Contract No. 26-306 to Toneman Development Corp (Contractor), in the amount of $960,926, establishing a construction completion date of 210 calendar days from the date of issuance of the Notice to Proceed (NTP).

 

On May 29, 2026, following award of the construction contract, the NTP was issued with a construction start date of June 15, 2026. During construction, it was discovered that the existing site elevations and subterranean electrical conduit routes differed from the site record drawings. In addition, increased structural steel capacity is required in the foundation to support both the prefabricated metal building and the weight of fire engines.

 

Approval of Amendment No. 1 to Contract No. 26-306, in the amount of $77,859, will compensate the Contractor for additional work required to construct a concrete swale with appropriate drainage, reroute electrical infrastructure to correct discrepancies in site record drawings, and perform necessary structural reinforcements to the building foundation.

 

Public Contract Code section 20136 requires all amendments to construction contracts to have four votes.
