FINANCIAL IMPACT

The agreement with the California Department of Public Health (CDPH) for Acquired Immune Deficiency Syndrome (AIDS) Drug Assistance Program (ADAP) and Pre-exposure Prophylaxis Assistance Program (PrEP-AP) enrollment services is non-financial in nature and as such, does not impact Discretionary General Funding (Net County Cost).

 

BACKGROUND INFORMATION

The CDPH Office of AIDS (OA), as the lead state agency responsible for services related to human immunodeficiency virus (HIV) and AIDS, provides funding for ADAP and PrEP-AP. ADAP ensures people living with HIV/AIDS, who are uninsured and under-insured, have access to medication and treatment to suppress HIV/AIDS and related opportunistic infections. PrEP-AP increases access to PrEP, medication that greatly reduces the chance of getting HIV, for HIV-negative residents who are underserved and at risk of acquiring HIV.

 

CDPH requires the Department of Public Health (DPH) to enter into a non-financial agreement, which establishes guidelines for ADAP and PrEP-AP enrollment services. Since 1987, DPH has collaborated with CDPH to administer ADAP locally for individuals living with HIV who are uninsured or underinsured. DPH has served approximately 870 clients during the first two years of the current three-year agreement period.

 

On June 27, 2023 (Item No. 82), the Board of Supervisors approved non-financial Agreement No. 23-550 (State Agreement No. 23-10139) with CDPH for ADAP and PrEP-AP enrollment services, for the period of July 1, 2023 through June 30, 2027.

 

On June 24, 2026, DPH received Amendment No. 1 from CDPH, to Agreement No. 23-550 (State Agreement No. 23-10139 A1), updating the scope of work and other attachments, with no change to the agreement period of July 1, 2023 through June 30, 2027.

 

Updates to the scope of work include service locations, program contact information, and enrollment site requirements. Other attachments update the Budget Detail and Payment Provisions with a reference to the Contractor’s Release attachment, update the Special Terms and Conditions to reflect Executive Order N-6-22 Economic Sanctions, replace the HIPAA Business Associate Addendum with the current version used by CDPH, delete outdated language, and relabel following attachments: Restrictions and Requirements for the Use and Disclosure of HIV/AIDS Public Health Data; Contractor’s Release; Security Requirements, Protections, and Confidentiality Checklist; ADAP and PrEP-AP Document Transfer Plan; and Confidentiality Requirements.

 

DPH recommends approval of this item to ensure the agreement remains accurate and compliant and to continue providing ADAP and PrEP-AP enrollment services for individuals living with or at risk of acquiring HIV/AIDS.
