Recommendation
Approve State of California Program Supplement Agreement (Program Supplement No. B025 to State Master Agreement No. 08-5954S21) with the State of California Department of Transportation, to provide $35,000 in State Active Transportation Program Cycle 5 funds toward the $45,000 Pedestrian Education around Muscoy and Vermont Elementary Schools Non-Infrastructure costs, for the term of August 18, 2026 through June 30, 2030.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost).
The total estimated cost of the Pedestrian Safety Program Non-Infrastructure (NI) component for the Muscoy and Vermont Elementary Schools in the unincorporated Muscoy area (Project) is $45,000. The Project is funded with $35,000 in State Active Transportation Program (ATP) Cycle 5 grant funds administered by the California Department of Transportation (Caltrans). The remaining cost will be a local match of $10,000 in Gas Tax revenue. Sufficient revenue and appropriation are included in the Department of Public Works (Department) 2026-27 Road Operations budget (IO 3001108, 800330, H15130) and will be included in future recommended budgets as necessary.
BACKGROUND INFORMATION
The Project involves implementation of a Pedestrian Safety Program, NI component, in the unincorporated community of Muscoy. The NI component includes pedestrian and school-area safety education, community outreach, Safe Routes-to-School program support, and related activities that are being delivered under the ATP Cycle 5 award.
On March 25, 2020, the California Transportation Commission announced the ATP Cycle 5 call for projects. On August 25, 2020 (Item No. 40), the Board of Supervisors (Board) authorized submission of a grant application to Caltrans under the ATP Cycle 5 and was successful in securing competitive grant funding. On May 4, 2021 (Item No. 47), the Board accepted the ATP Cycle 5 award in the amount of $1,881,000 for Pedestrian Safety Improvements and NI programming.
On September 21, 2021 (Item No. 34), the Board approved Master Agreement No. 21-687 and State of California (Master Agreement No. 08-5954S21), which established terms and conditions applicable to County transportation projects receiving state funds. In accordance with Master Agreement No. 21-687 approval of a Program Supplement Agreement is required for each specific Project and prior to the County invoicing for reimbursement of Project costs. The Program Supplement Agreement establishes special covenants as a condition for the local agency to receive federal aid through the State for a designated project. The Program Supplement Agreement also identifies the type of funds available for reimbursement.
This action meets the County and the Chief Executive Officer’s goals and objectives of working cooperatively with Caltrans to ensure that the necessary agreements are executed in accordance with Caltrans guidelines to receive reimbursement for project expenditures.
