RECOMMENDATION(S)
Recommendation
1. Approve the following addenda to the bid documents for the Muscoy Area Pedestrian Improvements Project in the Muscoy area:
a. Addendum No. 1 issued on March 24, 2026; and
b. Addendum No. 2 issued on March 30, 2026.
2. Award construction contract to Roadway Engineering & Construction Corp. in the amount of $3,078,221.20 for the Muscoy Area Pedestrian Improvements Project in the Muscoy area.
3. Authorize a contingency fund of $307,822 for the Muscoy Area Pedestrian Improvements Project in the Muscoy area.
4. Authorize the Director of the Department of Public Works to approve the expenditure of the contingency fund of $307,822 for verified quantity overruns for this unit priced construction contract.
5. Authorize the Director of the Department of Public Works to order any necessary changes or additions in the work being performed under the contract for a total amount not to exceed $166,411 of the $307,822 contingency fund, pursuant to Public Contract Code section 20142.
6. Authorize the Director of the Department of Public Works to accept the work when 100% complete and execute and file the Notice of Completion.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The Department of Public Works (Department) is funded by Gas Tax revenue, fee revenue, and other state and local funding. The construction contract of $3,078,221.20 and any use of the proposed contingency fund for the Muscoy Area Pedestrian Improvements Project in the Muscoy area (Project) will be funded with Senate Bill 1 (SB1) Road Maintenance and Rehabilitation Account (RMRA) revenue and $1,271,000 in Senate Bill 1 Active Transportation Program funds (ATP) administered through the State of California Department of Transportation (Caltrans). Sufficient appropriation and revenue are included in the Department’s 2025-26 Road Operations budget (6650002000 H15130).
BACKGROUND INFORMATION
The Project will consist of pavement rehabilitation and the installation of pedestrian safety improvements, which include crosswalks, pedestrian flashing beacons, signage, speed feedback signs, sidewalks, and the construction of new or replacement of existing curb ramps at various locations in accordance with current design standards and pursuant to the Americans with Disabilities Act (ADA) guidelines.
On July 12, 2022 (Item No. 32), the Board of Supervisors (Board) determined the Project was exempt under the California Environmental Quality Act, approved the Project as defined in the Notice of Exemption, and directed the Clerk of the Board to file and post said notice on July 12, 2022.
This Project will have a ten percent contingency fund of $307,822 to compensate the contractor for verified quantity overruns, as well as changes in the contract under certain circumstances. Under an established formula based on the contract amount, Public Contract Code section 20142 allows the Board to authorize the Director of the Department to order changes in the contract, including for unforeseen conditions or design shortfalls, should they become necessary in the future, for a total amount not to exceed $166,411 of the $307,822 contingency fund.
Following Board approval of this item, construction is anticipated to commence in June 2026 and be completed by November 2026.
PROCUREMENT
On February 12, 2026, the Assistant Executive Officer approved the Project’s plans and specifications, as well as authorized the Director of the Department to advertise the Project for bids. This Project was advertised in the San Bernardino County Sun newspaper on March 3, 2026, and released on the County electronic procurement network (ePro) on March 4, 2026. Notice inviting bids were also provided to specified construction trade journals identified pursuant to Public Contract Code section 22036.
The following addenda were issued during the bidding phase:
Addendum No. 1: Revised the pre-bid meeting date, and bidder questions deadline extended.
Addendum No. 2: Revised the bid opening time, revised plan sheets and bid sheets, and provided answers to questions asked.

Upon receipt of the bids, the Department determined that the bid submission from Shiraz Construction was deemed non-responsive because the bidder was not listed on the ePro plan holder’s list as required by the Instruction to Bidders and special provisions.
The Department has reviewed the remaining bids received and determined that they are responsive, and recommends entering into a contract with Roadway Engineering & Construction Corp., the responsive, lowest responsible bidder. No appeal/protest letters were received.
