RECOMMENDATION(S)
Recommendation
1. Approve Amendment No. 1 to Cooperation Agreement No. 14-386 for the HOME Investment Partnership Program Consortium between San Bernardino County and the cities of Chino Hills and Rancho Cucamonga, to be in compliance with the updated provisions in the United States Housing and Urban Development Community Planning and Development Notices, for July 1, 2024 through the term of the HOME Investment Partnership Program Consortium.
2. Authorize the Chief Executive Officer to execute any amendments, modifications, and subsequent non-substantive acts pertaining to the implementation of the Cooperation Agreement, subject to County Counsel review.
3. Direct the Chief Executive Officer to transmit future amendments to the Cooperation Agreement to the Clerk of the Board of Supervisors within 30 days of execution.

This item will not result in the use of Discretionary General Funding (Net County Cost) as all revenue and related costs associated with this action will be included in future recommended HOME Investment Partnerships Program (HOME) grant budgets.
BACKGROUND INFORMATION
Cooperation Agreement No. 14-386 (Cooperation Agreement) for San Bernardino County’s HOME Consortium between San Bernardino County and the cities of Chino Hills and Rancho Cucamonga was approved by the Board of Supervisors on June 17, 2014 (Item No. 48).
This agreement includes an automatic three- year renewal provision, as required by United States Department of Housing and Urban Development (HUD) for the purpose of streamlining the process for a County HOME Consortium to requalify as an eligible recipient of HOME funds. The automatic process is implemented via written correspondence between the County and the cities.
In March 2023, both cities notified the County of their desire to continue to be included in the County’s HOME Consortium. The City of San Bernardino was a part of the County’s HOME Consortium under Cooperation Agreement No. 14-386, but elected to leave the Consortium in 2020 and declined the County’s recent invitation to rejoin the Consortium. The Consortium will remain in effect for as long as a city continues to remain in the Consortium.
Every three years, the County is requalified by HUD through a requalification process as a HOME Consortium to receive HOME funds from HUD. As a HOME Consortium, the County and the HOME Consortium cities of Chino Hills and Rancho Cucamonga qualify for an allocation of HOME funds for 2023-24 through 2026-27. HUD has requested that the Cooperation Agreement be amended to be updated with the provisions in the HUD Community Planning and Development Notices. The HOME allocation will support the construction of new and rehabilitated affordable housing units.
San Bernardino County is responsible for the application, receipt, and implementation of HOME funds on behalf of all HOME Consortia members. The County adopts a Five-Year Consolidated Plan and corresponding Annual Action Plans to establish the planning framework under which HOME funds will be utilized.
In addition to HOME funds, the County receives an allocation of Community Development Block Grant (CDBG) funds from HUD. The CDBG program is older than the HOME program and, as such, cities that are a part of the County’s CDBG program are automatically included in the County’s HOME program (Consortium). The cities in the County’s CDBG program entered into a separate Cooperation Agreement that does not need to be amended. These cities are Adelanto, Barstow, Big Bear Lake, Colton, Grand Terrace, Highland, Loma Linda, Montclair, Needles, Redlands, Twentynine Palms, Yucaipa, and the Town of Yucca Valley.
