RECOMMENDATION(S)
Recommendation
Acting as the governing body of the San Bernardino County Flood Control District (District):
1. Approve Addendum No 1, issued on December 30, 2019, Addendum No 2, issued on January 6, 2020, Addendum No 3, issued on January 14, 2020, Addendum No 4, issued on January 28, 2020 to the bid documents for the Etiwanda Channel Invert Repair project (Project).
2. Award a contract to Mamco, Inc. dba Alabassi (Perris, CA) in the amount of $2,277,777 for the Project in the Fontana area.
3. Authorize a contingency fund of $227,777 for the Project.
4. Authorize the Chief Flood Control Engineer and/or Interim Chief Flood Control Engineer of the District to approve the expenditure of the contingency fund of $227,777 for verified quantity overruns for this unit priced construction contract.
5. Authorize the Chief Flood Control Engineer and/or Interim Chief Flood Control Engineer to order any necessary changes or additions in the work being performed under the contract for a total amount not to exceed $126,388 of the $227,777 contingency fund, pursuant to Public Contract Code section 21061(d).
6. Authorize the Chief Flood Control Engineer and/or Interim Chief Flood Control Engineer to accept the work when 100% complete and execute and file the Notice of Completion.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The District is funded by property taxes, fees, local, state, and federal funding. The construction contract of $2,277,777 and contingency fund of $227,777 will be funded with property tax revenue. The necessary budget adjustments for the Project are included in the Second Quarter Budget Report for fiscal year 2019-20. Sufficient appropriation and revenue will be included in future recommended budgets (1910002518-F02615).
BACKGROUND INFORMATION
The Project will repair approximately 1.9 miles of the Etiwanda Channel invert due to erosion. The work will consist of concrete overlay or thermoset vinyl polymer overlay. No work is proposed outside of the channel. The Project is located in the City of Fontana, between South West Liberty Parkway and Interstate 210. All work for this Project will be performed within existing District right-of-way and no additional right-of-way will be acquired.
A Notice of Exemption for maintenance activities under the California Environmental Quality Act within the channel was filed in October of 2016 with the Clerk of the Board. It has been determined the activities, as described above, fall under this exemption for maintenance.
Following Board of Supervisors (Board) approval of this item, construction is anticipated to commence in May of 2020 and to be completed by mid-August of 2020.
PROCUREMENT
This Project was advertised in the Daily Press newspaper on December 3, 2019, in the Precinct Reporter on December 5, 2019, and released on the County Electronic Procurement Network (ePro) on December 3, 2019. Notice inviting bids was also provided to specified construction trade journals as required by Public Contract Code section 22036. On February 6, 2020, the following five bids were received:

There were four addendums issued during the bidding phase:
Addendum No. 1: Postponed the bid opening date and changed the Pre-bid meeting location.
Addendum No. 2: Amended the Special Provisions, replaced Page NC-3.
Addendum No. 3: Postponed the bid opening date.
Addendum No. 4: Postponed the bid opening date, replaced Page SP-32 thru Page SP-33. Added Section 10-1.20, Section 10-2.21, Section 10.1.22. Replaced Page P-3. Added paragraph 7 to Section 10-1.06.
The District reviewed the bids received and determined that they are responsive, and recommends that the Board award the contract to Mamco, Inc. dba Alabassi, the lowest responsive bidder. No appeal/protest letters were received.
This Project will have a 10 percent contingency fund of $227,777 to compensate the contractor for verified quantity overruns, as well as changes in the contract under certain circumstances. Under an established formula based on the contract amount, Public Contract Code section 21061(d) allows the Board to authorize the Chief Flood Control Engineer/Interim Chief Flood Control Engineer to order changes in the contract, including for unforeseen conditions or design shortfalls, should they become necessary in the future, for a total amount not to exceed $126,388 of the $227,777 contingency fund.
