RECOMMENDATION(S)
Recommendation
Acting as the governing body of County Service Area 70 D-1 Lake Arrowhead:
1. Find that the County Service Area 70 D-1 Lake Arrowhead - Mackay Park Pickleball Courts Project is exempt under the California Environmental Quality Act, Title 14 of the California Code Regulations Section 15302 Class 2 (Replacement or Reconstruction of Existing Structures).
2. Approve the County Service Area 70 D-1 Lake Arrowhead - Mackay Park Pickleball Courts Project as defined in the Notice of Exemption.
3. Approve plans and specifications for the County Service Area 70 D-1 Lake Arrowhead - Mackay Park Pickleball Courts Project.
4. Authorize the Director of the Department of Public Works - Special Districts to advertise the County Service Area 70 D-1 Lake Arrowhead - Mackay Park Pickleball Courts Project for competitive bids.
5. Direct the Department of Public Works - Special Districts to file and post the Notice of Exemption in accordance with the California Environmental Quality Act

FINANCIAL IMPACT
Approval of this will not result in the use of Discretionary General Funding (Net County Cost). On September 21, 2021 (Item No. 18) and November 16, 2021 (Item No. 33), the Board of Supervisors (Board) approved an allocation of $4 million and $7 million, respectively, to the Board Discretionary Fund - District Specific Priorities Program (Priorities Program), for each of the five supervisorial districts for projects that meet a public purpose, and provide services to citizens that promote health, safety, economic well-being, and other public services that enhance quality of life and meet the needs of the County residents. On an annual basis, unspent appropriations for discretionary funding will be carried over into the subsequent year’s budget.
On September 12, 2023 (Item No. 76), the Board approved an allocation of $585,000 for the design and construction costs from the Third District’s Priorities Program budget for the County Service Area 70 (CSA) D-1 Lake Arrowhead - MacKay Park Pickleball Courts Project (Project).
Sufficient appropriation for the Project is included in the CSA 70 D-1 Lake Arrowhead (District) Fund’s 2023-24 budget and will be included in future recommended budgets, as necessary.
BACKGROUND INFORMATION
MacKay Park is located in Lake Arrowhead and is maintained and operated by the Department of Public Works - Special Districts (Department). The Project consists of the installation of five pickleball courts, removal of the existing volleyball court, and relocation of the existing exercise equipment throughout the park. With the addition of these courts, there will be a total of eight pickleball courts.
Department staff reviewed the Project and determined that a categorical exemption in accordance with the California Environmental Quality Act (CEQA) Guidelines, Title 14 of the California Code of Regulations, Section 15302 Class 2 Categorical Exemption is appropriate. Class 2 consists of the replacement or reconstruction of existing structures and facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced. When the Board considers the environmental finding, the filing and posting of a Notice of Exemption is recommended.
In addition to the CEQA finding, this item seeks Board approval of the Project’s plans and specifications and authorizes the Department Director to advertise the Project for competitive bids.
PROCUREMENT
Upon approval of this item, the Project will be advertised in accordance with Section 22037 of the California Public Contract Code. The Department anticipates returning to the Board in August 2024 for award of the construction contract.
