RECOMMENDATION(S)

Recommendation

1.                     Approve a Freeway Maintenance Agreement, effective upon execution by the State of California Department of Transportation, between County and the State of California Department of Transportation that updates and supersedes portions of the previous executed Freeway Maintenance Agreement (County Contract No. 86-819), and defines the control and maintenance of roads and highways lying within the unincorporated region of the County of San Bernardino (County) along Interstate 15 (I-15) and Interstate 215 (I-215), in the Devore and San Bernardino areas.

2.                     Adopt resolution that accepts portions of Cajon Boulevard and Sycamore Creek Drive that crosses I-15 and I-215 in the County unincorporated areas of Devore and San Bernardino into the County Maintained Road System.

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). There are minor administrative costs associated with the approval of Cajon Boulevard and Sycamore Creek Drive as County roads; and the roadway maintenance obligations assigned to the County under this Freeway Maintenance Agreement (FMA) are or will be included as part of the annual County road maintenance budget. Sufficient appropriation is included in the Department of Public Works (Department) 2019-20 Transportation budget (6650002000).

 

BACKGROUND INFORMATION

The purpose of the item is to update or supersede portions of the existing FMA (County Contract No. 86-819) between the County and the State of California Department of Transportation (Caltrans) regarding roads that crosses I-15 and I-215, in the Devore and San Bernardino areas. On September 8, 1986 (Item No. 38), the County’s Board of Supervisors (Board) approved County Contract No. 86-819. The FMA clarifies the division of the control and maintenance responsibilities of the County and Caltrans for interchanges along I-15 and I-215. Caltrans has made some modifications to the subject interstates since the execution of County Contract No. 86-819, which necessitates an update to the FMA. The County is responsible for the maintenance of County/local roads crossing over or under I-15 and I-215, and Caltrans is responsible for the maintenance of the bridge structures. The areas of County control and maintenance relative to this FMA are shown in Exhibits “A” and “C” of the proposed FMA.

 

On August 21, 2012, (Item No. 43), the Board entered into a Freeway Agreement No. 08-SBD-15-PM/08-SBD-215-PM (County Contract No. 12-581) (Freeway Agreement) with Caltrans wherein County agrees to accept control and maintenance over each of the relocated or reconstructed roads included in the Freeway Agreement upon receipt of the Notice of Completion from Caltrans. The Department staff has received the Notice of Completion dated January 23, 2018. In accordance with the Freeway Agreement, County and Caltrans desire to enter into the proposed FMA, which establishes the parties’ understanding of the control and maintenance of Sierra Avenue, Sycamore Creek Drive, Glen Helen Parkway, Glen Helen Road, Devore Road, Cajon Boulevard, and Kenwood Avenue that cross over or under I-15 and I-215 in the Devore and San Bernardino areas, as shown in Exhibits A and C, attached to the FMA. However, prior to County’s control and maintenance of Cajon Boulevard and Sycamore Creek Drive, the roads must become part of the County Maintained Road System (CMRS).

 

Pursuant to California Streets and Highway Code section 941, the Board may, by proper order, accept into the CMRS roads that are necessary to public convenience. The proposed roads are as follows:

Additionally, Sycamore Creek Drive was not included in the previous approved Freeway Agreement that consented to Caltrans realignment, improvement, or closure of portions of County roads along I-15 and I-215 in the Devore and San Bernardino areas. The subject roads are local roads within the State of California rights of way, which designates County as the responsible agency for control and maintenance of the roads upon execution of the proposed FMA. Upon approval of Recommendation 2, the above-mentioned segments of Cajon Boulevard and Sycamore Creek Drive shall become part of the CMRS.

 

This FMA shall be in force until it is terminated by mutual written consent by both parties, or if County fails to comply with the provisions of the FMA, the failure may be grounds for a notice of termination by Caltrans. Execution of this FMA meets the County’s goal and objective of working with Caltrans to ensure that roads, streets and highway along I-15 and I-215 in the Devore and San Bernardino areas are controlled and maintained by the appropriate agency.
