RECOMMENDATION(S)
Recommendation
1. Approve Capital Improvement Program projects for Regional Parks at Glen Helen Amphitheatre located at 2555 Glen Helen Parkway in San Bernardino:
a. HVAC Replacement Project (CIP 20-117) in the amount of $132,000
b. Pedestrian Fence Widening Project (CIP 20-114) in the amount of $41,308
2. Approve appropriation and revenue adjustments to fund the Capital Improvement Program projects and authorize the Auditor-Controller/Treasurer/Tax Collector to post the necessary budget adjustments, for a total amount of $173, 308 as detailed in the Financial Impact Section. (Four votes required).

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). Regional Parks Department (Department) will fund the Capital Improvement Program (CIP) project budgets for the Heating, ventilation, and air conditioning (HVAC) Replacement ($132,000) and Pedestrian Fence Widening ($41,308) with the Use of Fund Balance from Fund 2732-Amphitheatre Improvements at Glen Helen in the total amount of $173,308.

BACKGROUND INFORMATION
The Department has an on-going Lease Agreement (92-1023) with Live Nation which states “The Parties agree to establish and fund an improvement fund.” The improvement fund is maintained by the County as a separate interest bearing fund. The purpose of the improvement fund is to pay for the “modernization and improvements to the Premises [Amphitheater at Glen Helen Regional Park] and its facilities on the Premises…” Each party must agree on the use of the improvement fund. Live Nation staff operating the Glen Helen Amphitheatre submitted requests for replacement of specified HVAC units and the widening of the pedestrian path in the general parking lot. After review of the two requests, the Department also agreed with the need for both projects.
The first project addresses the HVAC units at Glen Helen Amphitheatre. The existing HVAC units were installed around 1992. Live Nation has performed routine maintenance of the HVAC units but they are no longer functioning properly and are beyond repair. The project scope of work includes purchase and installation of heating, ventilation, and air conditioning units for Administrative offices, administration main area, Green room, and Production room at the Amphitheatre. A CIP request has been submitted to the Project Management Division (PMD) for approval in the amount of $132,000 for the project.
The second project addresses a health and safety hazard at Glen Helen Amphitheatre. The Amphitheatre’s general parking lot contains a dedicated pedestrian path of travel that conveys pedestrian traffic from areas to the main Amphitheatre entrance. The existing path of travel is six (6) feet wide and bordered on both sides by a chain-link fence. The County Fire Marshal informed Live Nation staff that the pedestrian path must be a minimum of nine (9) feet wide. The Pedestrian Path Widening project scope consists of moving 1,210 linear feet of existing fence over four (4) feet and parallel to its current location. This project will maintain existing spacing of openings and interval of openings (approximately every 300 feet). The path will need to be scraped and paved. A CIP has been submitted to PMD for approval in the amount of $41,308 for the project.
The Department will transfer the total estimated cost of $173,308 to PMD for both CIP projects, upon the Board of Supervisors approval.
This recommended budget adjustment aligns with the County and Chief Executive Officer Goals and Objectives to Improve County Government Operations, Operate in a Fiscally-Responsible and Business-Like Manner, Provide for the Safety, Health and Social Service Needs of County, and Pursue County Goals and Objectives by Working with Other Agencies by allowing the Department to address these safety concerns.
