Recommendation

1.                     Accept the Certified Election Results for the 2019 San Bernardino County Employees’ Retirement Association Election held on December 3, 2019.

2.                     Adopt Resolution declaring the results of one General Member, one Retired Member, and one Alternate Retired Member for the 2019 San Bernardino County Employees’ Retirement Association Election.

FINANCIAL IMPACT

Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). Appropriation for the minimal staffing required to present the Certified Election Results was included in the Registrar of Voters 2019-20 budget. The Memorandum of Understanding (MOU) between the County and San Bernardino County Employees’ Retirement Association (SBCERA) approved March 2, 2010 (Item No. 19), allows for the recovery of costs from SBCERA related to providing election services. Adequate appropriation and revenue have been included in the Registrar of Voters 2019-20 budget.

 

BACKGROUND INFORMATION

Declaring the winners of the 2019 SBCERA Election held on December 3, 2019, will enable SBCERA to install their newly elected members of the Board of Retirement when the three-year terms for these offices commence on January 1, 2020.

 

On July 9, 2019 (Item No. 45), the Board of Supervisors called a Board of Retirement election to be held and conducted on December 3, 2019, for the purpose of having the general members of SBCERA elect one member and the retired members of SBCERA elect one member and one alternate member.

 

Pursuant to the MOU, the Registrar of Voters provided mail ballot election services to SBCERA in accordance with SBCERA Policy No. 006 Board of Retirement Elections.  The SBCERA Policy requires that its elections be conducted generally pursuant to the provisions of California Uniform District Election Law (Elections Code sections 10500 to 10556) and vote by mail procedures (Elections Code sections 3000 to 3026).

 

Ballots for this election were mailed to SBCERA members (21,970 to general members and 11,560 to retired members) on November 4, 2019, for return to the Registrar of Voters by 5 p.m. on December 3, 2019. SBCERA member participation in the election was as follows: 7.46 percent of general members cast ballots and 29 percent of retired members cast ballots.

 

The Certified Election Results for the 2019 SBCERA Election includes a Certified Statement of Election Results and a Summary of Certified Election Results report, which lists the total number of votes cast for each candidate. The summary results report is attached to the Resolution and is on file with the Clerk of the Board and the Registrar of Voters. The results show that the following candidates received the highest number of votes for each office on the ballot: Louis Fiorino for the office of General Member, Dawn Stafford for the office of Retired Member, and Harry Howard Hatch for the office of Alternate Retired Member. It is recommended the Board of Supervisors adopt the Resolution, declaring these three candidates the winners for these offices.
