RECOMMENDATION(S)
Recommendation
1. Conduct a public hearing on proposed ordinance to adopt by reference the updated Model Water Efficient Landscape Ordinance.
2. Adopt proposed ordinance to add Chapter 22 to Division 3 of Title 6 of the San Bernardino County Code, adopting by reference the updated Model Water Efficient Landscape Ordinance contained in Title 23 of the California Code of Regulations, which was introduced on March 24, 2020, Item No. 77.

FINANCIAL IMPACT
Consideration of this item will not result in the use of Discretionary General Funding (Net County Cost). Sufficient appropriation and revenue to complete this action have been included in the Land Use Services' Planning 2019-20 budget. Implementation will be executed jointly by the Planning Division and Building & Safety Division, each of which have adequate budget and staffing resources.

BACKGROUND INFORMATION
The ordinance relating to the adoption by reference of the updated Model Water Efficient Landscape Ordinance (MWELO) was introduced on March 24, 2020, Item No. 77. The recommendation before the Board of Supervisors today would adopt the ordinance by reference. Approval of this item will ensure continued compliance with state law, which requires that all local agencies must adopt, implement, and enforce the MWELO contained in Sections 490-495, Chapter 2.7, Division 2, Title 23 of the California Code of Regulations or a more stringent ordinance.
