Recommendation
Authorize the Purchasing Agent to increase Purchase Order No. 4100103636 with Meyers Nave Riback Silver & Wilson (Meyers Nave) by $75,000, from $334,000 to a not-to-exceed amount of $409,000, in order to continue the provision of legal services in connection with the lawsuit initiated by the County of San Bernardino in the matter of County of San Bernardino v. City of Fontana (UST-CB Partners, L.P.), Case No. CIVDS1911476 that concerns the City of Fontana's approval of the West Valley Logistics Specific Plan Project (Four votes required).

FINANCIAL IMPACT
This item will result in the use of Discretionary General Funding (Net County Cost). The costs for the identified legal services for the matter County of San Bernardino v. City of Fontana are recommended to be funded with available appropriation in Countywide Discretionary Fund (116 1000). Sufficient appropriation and revenue are included in the respective 2019-20 budget.

BACKGROUND INFORMATION
On April 12, 2019, the County of San Bernardino (County) initiated litigation against the City of Fontana (City) regarding the City's approval of the West Valley Logistics Specific Plan Project. The case is entitled County of San Bernardino v. City of Fontana, et al. (CIVDS 1911476). Meyers Nave is representing the County in the litigation. The trial is scheduled for April 30, 2020.
