FINANCIAL IMPACT
Approval of this item will not impact Discretionary General Funding (Net County Cost). The proposed amendment provides clarifying language relating to billing of Special Fees and is non-financial in nature.

BACKGROUND INFORMATION
Under Contract No. 19-390, Inland Defenders, Inc. may, for extraordinarily complex cases, request written approval of the Superior Court for Special Fees, allowing billing for the case under the Superior Court's Appointed Services Fee Schedule felony case hourly billing and appearance rates, rather than under the Contract's fee schedule. The Contract requires the Contractor to receive prior written approval of the Superior Court for Special Fees, but does not specify at what point in the case proceedings the request must be approved by the Superior Court. This Amendment No. 1 will revise the Contract to specify that the Contractor must receive written approval of the Court prior to trial setting conference to be eligible to bill Special Fees, unless extenuating circumstances exist as determined by the Superior Court.
