Recommendation
Approve non-financial Agreement (State Agreement No. 20-10101) with the California Department of Public Health for Acquired Immune Deficiency Syndrome Drug Assistance Program and Pre-Exposure Prophylaxis Assistance Program enrollment services, for the period of July 1, 2020 through June 30, 2023.

The recommended agreement is non-financial in nature and as such, does not impact Discretionary General Funding (Net County Cost).
BACKGROUND INFORMATION
California Department of Public Health (CDPH) requires the Department of Public Health (DPH) to enter into a non-financial agreement which establishes guidelines for Acquired Immune Deficiency Syndrome (AIDS) Drug Assistance Program (ADAP) and Pre-Exposure Prophylaxis Assistance Program (PrEP-AP) enrollment services. DPH has been receiving funding from the State since 1987 to administer ADAP locally for low-income HIV positive individuals who are uninsured or underinsured. Approval of this item allows DPH to enter an agreement with CDPH to administer the ADAP and PrEP-AP enrollment sites for the period of July 1, 2020 through June 30, 2023.
The recommended agreement establishes program specific guidelines and expectations, such as identifying ADAP enrollment site coordinators, training, and certification of DPH staff, record retention policies, and security requirements. As an ADAP enrollment site, CDPH has identified DPH as a business associate and has incorporated the requisite Health Insurance Portability and Accountability Act (HIPAA) and business associate language as an addendum into the recommended agreement, as well as guidelines for the use and disclosure of public health data.
Persons living with HIV/AIDS who wish to enroll or update enrollment must do so with a trained ADAP enrollment worker. DPH trains staff as ADAP enrollment workers at HIV clinic sites in the cities of San Bernardino, Ontario, and Hesperia, which serve as ADAP enrollment sites. DPH anticipates serving approximately 900 clients over the three-year period.
