RECOMMENDATION(S)

Recommendation

1.                     Approve Amendment No. 1 to Revenue Agreement No. 19-378 (State Agreement No. 19112315 A1) with the State of California, Commission on Peace Officer Standards and Training, extending the Agreement period from July 1, 2019 through September 30, 2020, with no changes to the Agreement amount not to exceed $9,900 for the Sheriff/Coroner/Public Administrator to provide Law Enforcement Driver Simulator and Force Option Simulator training courses.

2.                     Approve Revenue Agreement (State Agreement No. 20112315) with the State of California, Commission on Peace Officer Standards and Training for the period of July 1, 2020 through June 30, 2021, in an amount not to exceed $9,900 for the Sheriff/Coroner/Public Administrator to provide Law Enforcement Driver Simulator and Force Option Simulator training courses.

FINANCIAL IMPACT

Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). As a Commission on Peace Officer Standards and Training (POST) certified Regional Training Center, the Sheriff/Coroner/Public Administrator (Department) provides Law Enforcement Driver Simulator and Force Option Simulator mandated training and instructor courses, in-house, thus avoiding the cost of sending staff to offsite trainings.  Additionally, the Department receives revenue for providing the training to outside Law Enforcement (LE) agencies, which is contingent upon the number of students enrolled in these courses with the total amount reimbursed not to exceed $29,280. The POST establishes the instructor-to-student ratios and the rates of reimbursement for each course. The Department establishes minimum enrollment standards to ensure sufficient class size to achieve full cost recovery. Sufficient appropriation and revenue are included in the Department’s 2019-20 budget and will be included in the 2020-21 recommended budget.

 

BACKGROUND INFORMATION

Since 2000, the Department has had an annual agreement with POST to provide Law Enforcement Driving Simulator (LEDS) and Force Option Simulator (FOS) training courses to in-service California peace officers, with the latest being Agreement No. 19-378 approved by the Board of Supervisors (Board) on June 11, 2019 (Item No. 75). Approval of Recommendation No. 1 amends the contract to extend the term by three months from July 1, 2020 through September 30, 2020 to allow the Department to continue to bill POST directly for LEDS and FOS training courses at a rate of $110 per student, up to 90 students (not employed by the Department) for an amount not to exceed $9,900. Due to the COVID-19 pandemic, training dates were cancelled. The three-month extension will allow the department to provide additional training classes.

 

Approval of Recommendation No. 2 allows for the Department to bill POST directly for LEDS and FOS training courses at a rate of $110 per student, up to 90 students (not employed by the Department) for an amount not to exceed $9,900 from July 1, 2020 through June 30, 2021.

 

Also, on June 11, 2019 (Item No. 75), the Board approved Agreement No. 19-379 with POST for the Department to provide Instructor courses for LEDS and FOS training. Approval of Recommendation No. 3 will amend the contract by extending its period by three months from July 1, 2020 through September 30, 2020, to continue to provide those training services. Due to the COVID-19 pandemic, training dates were cancelled. The three-month extension will allow the department to provide additional training classes.

 

Approval of Recommendation No. 4 will allow for the Department to be reimbursed by POST for the LEDS Instructor course at a per student rate of $480, up to 20 students, for an amount not to exceed $9,600, and for the FOS Instructor course at a per student rate of $489, up to 20 students, for an amount not to exceed $9,780 for the period of July 1, 2020 through June 30, 2021.

 

These revenue agreements are initiated annually by POST, and rates for reimbursement are also established by POST. The agreements contain non-standard indemnification language consistent with state standard terms that has been reviewed by County Counsel, which is in agreement with the Department’s recommendations. The agreements may be terminated by either party upon 30 days’ advance written notice.
