Recommendation
Approve Amendment No. 1 to Agreement No. 19-504 with the City of Needles (City), extending the term of the agreement by three years, from June 30, 2020 to June 30, 2023, for the chip seal on Five Mile Station Road in the Needles area, with no change to the contributions of $17,000 by the City and $62,000 by the County of San Bernardino, for a total estimated cost of $79,000.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The County of San Bernardino’s (County) estimated share of cost for the chip seal project (Project) is $62,000, which will be funded with Senate Bill 1 Road Maintenance and Rehabilitation Account (RMRA) funds, as authorized by the Board of Supervisors on July 23, 2019 (Item No. 32). The City of Needles (City) will be responsible for its share of the cost, which is $17,000. Sufficient appropriation and revenue will be included in the Department of Public Works 2020-21 Road Operations recommended budget (6650002000 44H14968).
BACKGROUND INFORMATION
The chip seal work on Five Mile Station Road was anticipated to be completed by the spring of 2020. However, Pacific Gas & Electric (PG&E) has requested a time extension for their excavation permit to complete a project to remove chromium from groundwater that will be done within the County’s right-of-way on Five Mile Station Road. PG&E will be placing pipelines, injection and extraction wells, monitoring wells, improving access roads and constructing other improvements. In order to extend the excavation permit for the PG&E’s remediation project, the County’s chip seal project on Five Mile Station Road needs to be postponed. PG&E anticipated to complete their work by December of 2020 but their remediation project has been temporarily shut down due to Novel Coronavirus (COVID-19). Federal and state oversight agencies have asked PG&E to delay their project due to the COVID-19 pandemic to protect remediation project personnel and because agencies are unable to monitor construction activities due to travel restrictions. Construction is anticipated to begin on the County’s Project in the summer of 2021 and be completed by late summer of 2021. Because of the uncertainty of the status of PG&E project, the amendment is extended to three years.
The Department’s Operations Division will use its labor force to apply chip seal on various roads in the unincorporated area of Needles and in the City of Needles after PG&E completes their remediation project. The Project consists of preparation work, such as crack sealing, patching or leveling course, followed by the application of the chip seal.
This Agreement will terminate upon completion of the Project and the County receives payment of final billing from the City, or June 30, 2023, whichever occurs first. The City approved this Amendment on April 28, 2020.
The Project will ensure development of a well-planned, balanced and sustainable County by preserving and improving the structural integrity of existing road surfaces in the City and County unincorporated area. Furthermore, execution of the Agreement and approval of the Project allows the County to meet its goals and objectives by working cooperatively with the City.
