Recommendation

1.                     Approve Amendment No. 4 to Agreement No. 15-486 with Satellite Tracking of People, LLC, increasing the contract amount by $280,000, from $4,170,000 to $4,450,000, and extending the term by three months from June 30, 2020 to September 30, 2020, to provide Global Positioning System tracking services for the Probation Department.

2.                     Approve Amendment No. 3 to Agreement No. 15-487 with Satellite Tracking of People, LLC, increasing the contract amount by $102,500, from $2,320,000 to $2,422,500, and extending the term by three months from June 30, 2020 to September 30, 2020, to provide Global Positioning System tracking services for the Sheriff/Coroner/Public Administrator.

FINANCIAL IMPACT

Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). The Probation Department’s (Probation) Global Positioning System (GPS) tracking services costs are fully funded through a combination of 2011 Realignment (AB109) revenue and fees collected from referred offenders who pay based on a sliding fee scale as determined by their ability to pay. The cost of GPS tracking services provided for the Sheriff/Coroner/Public Administrator (Sheriff) will be recovered from fees charged to participants in the Penal Code Section 4024.2 Work Release program and Penal Code Section 1203.016 Home Detention/Electronic Confinement program and AB109. The current County Fee Ordinance establishes a monitoring program participant fee of $20 per day. This per day fee may be adjusted downward, as ordered by the Courts, based on the offender’s ability to pay; AB109 revenue funds the difference. Appropriation of $280,000 and $102,500 has been included in the 2020-21 Recommended Budget for the provision of GPS tracking services for Probation and the Sheriff, respectively.

 

BACKGROUND INFORMATION

On June 23, 2015 (Item No. 61), the Board of Supervisors (Board) approved Agreement No. 15-486 and Agreement No. 15-487 with Satellite Tracking of People, LLC (S.T.O.P.) to provide GPS tracking services. GPS is a satellite navigation system that allows the user to accurately pinpoint geographic locations. For the past several years, Probation has used GPS tracking services as a supervision tool for a variety of offenders, including gang members and sex offenders. Additionally, Probation uses this technology as a form of house arrest for high-risk juvenile offenders, which reduces the cost to maintain them within the juvenile detention system. The Sheriff has been using GPS tracking services to better monitor minimum security inmates and low risk offenders eligible for placement in a home detention program, in accordance with California Penal Code Section 1203.016.

 

On June 13, 2017 (Item No. 61), the Board approved Amendment No. 1 to Agreement No. 15-486, increasing the not to exceed amount by $580,000 from $1,350,000 to $1,930,000 with no change to the contract term of June 23, 2015 through June 30, 2018.

 

On May 22, 2018 (Item No. 125), the Board approved Amendment No. 2 to Agreement No. 15-486, increasing the not to exceed amount by $1,120,000 from $1,930,000 to $3,050,000 and Amendment No. 1 to Agreement No. 15-487, increasing the not to exceed amount by $410,000 from $1,500,000 to $1,910,000, exercising the first of two one-year options to extend the term both contracts through June 30, 2019.

 

On June 25, 2019 (Item No. 33), the Board approved Amendment No. 3 to Agreement No. 15-486 increasing the contract amount by $1,120,000 from $3,050,000 to $4,170,000; and Amendment No. 2 to Agreement No. 15-487, increasing the contract amount by $410,000 from $1,910,000 to $2,320,000 and exercising the second of two one-year options to extend the term of both contracts through June 30, 2020.

 

PROCUREMENT

On April 9, 2015, Probation issued a request for proposals (No. PROB 1459) to solicit qualified vendors to provide GPS tracking services, and three proposals were received. An evaluation committee consisting of representatives from Probation and the Sheriff evaluated the proposals and recommended S.T.O.P. as the proposer who best met the GPS tracking service needs of the County. 

 

Probation and Sheriff are in the process of negotiating new contracts based on a competitive procurement process conducted October 2012 by the National Association of State Procurement Officers (NASPO) that will be in place by October 1, 2020. The NASPO agreement has an effective date of May 1, 2013 through September 30, 2022. The submittal and review return times have increased due to limitations caused by the COVID-19 pandemic. Probation and the Sheriff request a three-month extension of the current agreements from June 30, 2020 through September 30, 2020, to allow additional time to complete the new contracts. The County Purchasing Department supports this request for extension. The current agreements include a closeout period provision. After termination of the contract, the contractor will cooperate in the transition of services to a new vendor, if necessary. This transition period shall not exceed 90 days. During the transition period, the contractor will continue to maintain services at the existing contract rate.

 

Probation and Sheriff will conduct a competitive procurement process beginning January 2022 to ensure that a new contract will be in place by October 1, 2022.
