Recommendation
Approve contracts with the following agencies for the provision of Non-Residential Drug Court Program services, in a total amount not to exceed $8,443,737, for the contract period of July 1, 2020 through September 30, 2024:
1. Clare|Matrix, for Adult and Juvenile Court services, in the amount not to exceed $1,940,974.
2. High Desert Child, Adolescent and Family Services Center, Inc., for Adult and Juvenile Court services, in the amount not to exceed $1,657,559.
3. Inland Valley Drug and Alcohol and Recovery Services, Inc., for Juvenile Court services, in the amount not to exceed $528,258.
4. Mental Health Systems, Inc., for Adult Court services, in the amount not to exceed $4,316,946.

FINANCIAL IMPACT
This item does not impact Discretionary General Funding (Net County Cost). The total cost for services will not exceed $8,443,737 and will be funded by 2011 Realignment, Drug Medi-Cal, and Substance Abuse Prevention and Treatment Block Grant funding. Adequate appropriation and revenue have been included in the Department of Behavioral Health’s (DBH) 2020-21 budget and will be included in future recommended budgets.
BACKGROUND INFORMATION
Drug court districts identify and then refer adult drug defendants with non-violent, felony drug violations, and juvenile offenders to the County’s comprehensive non-residential Drug Court Program, which provides a highly structured and strictly monitored treatment alternative to prosecution. The recommended agencies will provide Non-Residential Drug Court Program services to the San Bernardino, Fontana, Rancho Cucamonga, Redlands, Victorville, and Joshua Tree Drug Court districts. DBH anticipates that the agencies will provide countywide non-residential Adult Drug Court Program services to approximately 295 clients annually at an estimated cost of $5,643 per client and non-residential Juvenile Drug Court Program services to approximately 70 clients annually at an estimated cost of $4,601 per client.
DBH is responsible for providing mental health and substance use disorder services to San Bernardino County residents who are experiencing mental illness and/or substance use disorders. An integral part of the service delivery system consists of non-residential Drug Court Program services. DBH has been providing Drug Court Program services through contracted providers since 1994. Drug Court Programs work by bringing multiple sectors of the community together to address criminal offenders needs, ensuring consistency in judicial decision making, and enhancing the coordination of agencies and resources.
Adult drug courts employ a program designed to reduce drug relapse and criminal recidivism among defendants and offenders through risk and needs assessment, judicial interaction, monitoring and supervision, graduated sanctions and incentives, treatment and various rehabilitation services. Juvenile drug courts apply a similar approach that is tailored to the needs of youth with substance use disorders. These programs provide youth and their families with counseling, education and other services to: promote immediate intervention, treatment and structure; improve level of functioning; address problems that may contribute to drug use; build skills that increase their ability to lead drug and crime-free lives; strengthen the family's capacity to offer structure and guidance; and promote accountability for all involved.
PROCUREMENT
On January 21, 2020, the County Administrative Office approved and authorized the release of a Request for Proposals (RFP), RFP# 19-50, RFP# DBE20-ADMN-3678, to solicit interested and qualified organizations and agencies to provide Non-Residential Drug Court services. The RFP was publicly advertised through direct mailings to more than 400 community based organizations, educational providers, service providers, and other interested parties; advertised in local newspapers; and posted on the County of San Bernardino’s Electronic Procurement Network (ePro).
A total of 13 agencies attended the mandatory proposal conference on February 4, 2020. Four proposals were received in response to the RFP by the established deadline. All four proposals met the procurement requirements and continued in the evaluation process.

The evaluation committee, comprised of seven individuals with representation from the Department of Public Health t, Transitional Assistance Department, and DBH, reviewed and evaluated the proposals based on the criteria referenced in the RFP; including, but not limited to: demonstrated ability to serve the target population, ability to provide required services, demonstrated ability to serve the number of unduplicated participants, experience, staffing levels and qualifications, appropriateness of the facility, and ability to provide culturally competent services.
Based on the evaluation results, all of the evaluated proposers were recommended for contract award for the court districts listed below. The proposals submitted indicated these agencies will provide the most adequate and appropriate services, and will be ready to provide services by the contract start date at the specified court districts. These agencies are currently providing Non-Residential Drug Court program services to San Bernardino County residents. Mental Health Systems (MHS) is not being recommended to provide Juvenile Court District services to avoid duplication of services because the areas they proposed are already being served and their proposal was ranked lower than the other agencies during the evaluation process.
During negotiation meetings with the proposers, it was negotiated that the agencies would receive the same amount as fiscal year 2019-2020. During the meetings, Mental Health Systems withdrew their bid for the Big Bear and Victorville Adult Court Districts. DBH asked the remaining providers if they were interested in providing Adult Court services to Victorville and Big Bear. High Desert Child, Adolescent and Family Services Center, Inc. (HDCAFSC) was the only provider that accepted to serve the Victorville Adult Court. HDCAFSC is being recommended to serve the Victorville Adult Court because the agency has the infrastructure and staffing in place to avoid a break in service. DBH plans to request proposals for the Big Bear Adult Court District.

DBH will monitor contractor performance on a regular basis to ensure performance and compliance standards are met.
