RECOMMENDATION(S)

Recommendation

1.                     Approve Amendment No. 20 to Revenue Contract No. 02-1006 with California Speedway Corporation to update hourly rates (Schedule A), and to extend the term for the provision of supplemental law enforcement services on a fee-for-service basis from July 1, 2020 through June 30, 2021.

2.                     Approve Amendment No. 8 to Revenue Contract No. 14-110 with Live Nation Worldwide, Inc. to update contract language, hourly rates (Schedule A), and to extend the term for the provision of supplemental law enforcement services on a fee-for-service basis for events held at various County locations, from July 1, 2020 through June 30, 2021.

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The Sheriff/Coroner/Public Administrator’s (Department) 2020-21 recommended budget includes sufficient appropriation and revenue for public gathering events. Actual revenue received under these contracts is contingent on the level of service provided. The new hourly service rates (Schedule A) reflect an estimated 3.28% increase and include the full recovery of both direct and indirect costs associated with providing services under these contracts.

 

BACKGROUND INFORMATION

The Department has contracts with California Speedway Corporation (Speedway) and Live Nation Worldwide, Inc. (Live Nation), to provide supplemental law enforcement services for their respective events. The services provided are performed and priced on an overtime basis and do not impact regular patrol functions. The contracts are amended annually to update the hourly service rates. The overtime rates per safety position include indirect overhead costs, which recover the cost of support staff providing services to the Speedway and Live Nation.

 

On October 22, 2019 (Item No. 43) the Board of Supervisors (Board) approved amendments No. 19 and No. 7 for the contracts with Speedway and Live Nation, respectively, to adjust the hourly rates due to increases to salary and benefits for members of the Safety and Safety Management and Supervisory bargaining units without changes to the contracts’ terms ending on June 30, 2020. The proposed contract amendments with the two organizations amend the hourly rates, update contract language in the event there is a scheduling conflict, and extend the terms from July 1, 2020 through June 30, 2021.

 

Both contracts can be terminated by either party upon 90 day’s advance written notice.
