RECOMMENDATION(S)

Recommendation

1.                     Approve Cooperative Agreement between the County of San Bernardino and the City of Montclair, wherein the County will contribute $4,660,000 and the City of Montclair will contribute $250,000 towards the $4,910,000 estimated cost for roadway rehabilitation on Pipe Line Avenue and Chino Avenue in the Montclair and Chino areas (Project).

2.                     Authorize the Director of Public Works and/or Interim Director of Public Works to increase the County’s contribution amount under the Cooperative Agreement by up to 25 percent (from $4,660,000 to $5,825,000), should Project costs dictate such an increase.

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost).  The County of San Bernardino’s (County) estimated share of costs of $4,660,000 for the Project will be funded with Senate Bill 1 Road Maintenance and Rehabilitation Account (RMRA) funds. The City of Montclair (Montclair) is responsible for its share of cost of $250,000 for work within its jurisdiction. Sufficient appropriation and revenue for the Project are included in the 2020-21 Road Operations budget and will be included in future recommended budgets (6650002000 34H14974).

 

BACKGROUND INFORMATION

The Project consists of pavement rehabilitation on Pipe Line Avenue, from Chino Avenue north to Mission Boulevard, and on Chino Avenue, from State Highway 71 east to 0.13 miles east of Pipe Line Avenue. Additionally, the Project involves installing new curb ramps or updating existing ramps within the County and Montclair’s jurisdiction at various locations on Pipe Line Avenue, Chino Avenue, Riverside Drive and East End Avenue in order to comply with current Americans with Disabilities Act (ADA) requirements. Lastly, the Project includes the installation of a 60-inch storm drain and appurtenant structures in Pipe Line Avenue from Philadelphia Street to Del Mar Avenue. Because the Project area is shared with Montclair, the County and Montclair are entering into a Cooperative Agreement to identify their respective roles and responsibilities.

 

On February 11, 2020 (Item No. 58), the Board of Supervisors (Board) determined that the Project was exempt under the California Environmental Quality Act (CEQA), approved the Project as defined in the Notice of Exemption, and directed the Clerk of the Board to file and post notice.

 

In accordance with the terms of the Cooperative Agreement, the County is the lead agency in the design, survey, right-of-way engineering, CEQA compliance, and construction of the Project. The Project will require the acquisition of additional right-of-way within the County’s jurisdictional boundary, which will be presented to the Board as a separate item on a future date. No acquisition of right-of-way will be needed for that portion of the Project located within Montclair’s jurisdiction. Unless terminated prior to the award of the construction contract, the Cooperative Agreement terminates upon completion of the Project and payment by Montclair, or December 31, 2023, whichever occurs first. Montclair approved the Cooperative Agreement on May 5, 2020.

 

Construction is anticipated to begin in Spring of 2021 and be completed by Summer of 2021.

 

This Project will preserve and improve the structural integrity of the existing road surface and will also establish continuity of pedestrian walkways in the area which ensures the development of a well-planned, balanced, and sustainable county. Further, execution of the cooperative agreement and approval of the Project allows the County to meet its goals and objectives by working cooperatively with Montclair.
