RECOMMENDATION(S)
Recommendation
Approve Amendment No. 17 to Contract No. 96-880 with the United States Marshals Service to incorporate contract language for the monitoring of federal detainees on a case-by-case basis during court hearings conducted via video teleconferencing when the federal judiciary has restricted in-person presentation of a prisoner before the court, with no change to the current contract term of February 1, 2018 through January 31, 2023.

FINANCIAL IMPACT
Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). The Sheriff/Coroner/Public Administrator Department (Department) will be reimbursed by the United States Marshals Service (USMS) at the established per-diem rates for the housing of adult federal detainees housed at the County’s detention centers.
BACKGROUND INFORMATION
On September 17, 1996 (Item 25), the Board of Supervisors (Board) approved Contract No. 96-880 with the USMS establishing an Inter-Governmental Agreement (IGA No. 12-99-0035) for the County to provide housing and transportation of adult male and female federal detainees. The Board has subsequently approved amendments to the IGA with the latest being Amendment No. 16 (August 7, 2018; Item 25), in which the Board accepted new language and per-diem rates established by the USMS.
Due to the current COVID-19 pandemic, access to the courts has been greatly limited. In order to continue the legal cases for federal detainees, the USMS has requested the Department provide security during video conferences to continue the court hearing process. The proposed amendment allows for deputies to perform the requested video conference security.
There is no change to the current contract term of February 1, 2018 through January 31, 2023. Either party may terminate the Agreement, for any reason, with at least 30-calendar day advance written notice, unless an emergency situation requires the immediate relocation of federal detainees.
