RECOMMENDATION(S)
Recommendation
1. Ratify grant application submitted by the Sheriff/Coroner/Public Administrator to the City of Riverside for Fiscal Year 2019 Urban Areas Security Initiative (UASI) grant funding in the amount of $330,000 for the purchase of equipment for the Coroner, Dive Rescue Team, and Scientific Investigations Divisions.
2. Accept grant award in the amount of $330,000 from the City of Riverside for Fiscal Year 2019 UASI funding with a grant performance period of September 1, 2019 through May 31, 2022.
3. Authorize the Sheriff/Coroner/Public Administrator to execute the grant award letter and submit the document to the City of Riverside to secure the grant funding.
4. Approve Memorandum of Understanding (MOU) with the City of Riverside - Office of Emergency Management regarding the Fiscal Year 2019 UASI grant funding terms and conditions.
5. Adopt the “Proof of Authority”, as required by the MOU with the City of Riverside - Office of Emergency Management, in which the Board of Supervisors (Board), on behalf of the County, agrees to the following:
a. Any liability arising out of the performance of the MOU shall be the responsibility of the County and the Board;
b. Grant funds shall not be used to supplant expenditures controlled by the Board of Supervisors; and
c. The official executing the MOU is, in fact, authorized to do so.
6. Adopt resolution authorizing the Chairman of the Board, Chief Executive Officer, and/or the Sheriff/Coroner/Public Administrator to proceed with the following actions in relation to the Fiscal Year 2019 UASI grant sub-award:
a. Execute and file documents, including the MOU, with the City of Riverside - Office of Emergency Management needed for grant sub-award acceptance.
b. Act as signatories for reimbursement claims, performance reports, and other documents required to administer the grant sub-award.
c. Execute any non-substantive grant sub-award amendments, including those to extend the performance timelines, subject to review by County Counsel.
7. Direct the officials listed in Recommendation No. 6 to transmit all agreements and any amendments to the agreements in relation to the Fiscal Year 2019 UASI grant sub-award to the Clerk of the Board within 30 days of execution.

Sufficient appropriation and revenue have been included in the Sheriff/Coroner/Public Administrator’s (Department) 2020-21 recommended budget. No matching funds are required.
BACKGROUND INFORMATION
Approval of these items will allow the Department to accept the fiscal year 2019 UASI grant award and acquire the necessary needed equipment.
Since its inception in 2003, the intent of the UASI program has been to enhance regional preparedness in major metropolitan areas. UASI program funds address the unique planning, organization, equipment, training and response exercise needs of high-threat, high-density urban areas and assist in building capacity to prevent against, mitigate, respond to, and recover from acts of terrorism.
Eligible candidates for the 2019 UASI program have been determined through an analysis of relative risk of terrorism faced by the 100 most populous metropolitan areas in the United States. A total of 31 urban areas are eligible for funding under the 2019 UASI program, including the Riverside-San Bernardino-Ontario Urban Area. The City of Riverside’s Office of Emergency Management (City) administers the program for our area. The UASI Approval Authority, comprised of Riverside, San Bernardino, and Ontario City Managers, the Riverside County Executive Officer and the San Bernardino County Chief Executive Officer, determine projects recommended for funding for our UASI area. The projects are approved by the UASI Approval Authority and submitted to the State for final approval.
On November 19, 2018, the Department submitted a proposal to the City to fund the purchase of a Portable X-Ray Machine, a Gas Chromatograph/Mass Spectrometer (GCMS) and Dive Rescue Team equipment with 2019 UASI funding. On April 22, 2020, the Department received award letters from the City announcing that available funds from the California Office of Emergency Services, in the amount of $330,000, had been approved to acquire the requested equipment for the Coroner, Dive Rescue Team, and Scientific Investigations Divisions, with an overall performance period of September 1, 2019 through May 31, 2022. The request for acceptance of the grant award is being submitted at the first available Board date upon completion of the review process.
All resources acquired through this award will enhance and strengthen the Department’s ability to respond to catastrophic events by ensuring that adequate equipment is available to responding Divisions. The Department’s Criminalistic Laboratory provides forensic analysis support for all law enforcement agencies in the County of San Bernardino free of charge.
In addition to accepting the grant award, this item recommends that the Board ratify submission of the grant application by the Sheriff/Coroner/Public Administrator to the City in November 2018. This discrepancy has been addressed such that all current and future grant applications are processed following the procedures identified in County Policy 05-13. The grant award is also retroactive due to the performance period beginning on September 1, 2019 and the Department not receiving notification of award from the City until April 22, 2020.
Pursuant to County Policy 05-13, the Board must approve acceptance of all grant awards. The MOU establishes the terms and conditions of both parties in relation to this grant. The MOU includes a reciprocal mutual indemnification provision that requires both the City and the County to indemnify, defend, and hold each other harmless from and against all liability arising out their respective acts or omissions.
