RECOMMENDATION(S)

Recommendation

1.                     Approve amendment No. 1 to the Memorandum of Understanding (Agreement No. 18-59) with the Superior Court of San Bernardino County for the Sheriff/Coroner/Public Administrator to provide security services at the Big Bear Courthouse, extending the period by 18-months from July 1, 2020 through December 31, 2021.

2.                     Authorize the Sheriff/Coroner/Public Administrator, Undersheriff, or Assistant Sheriff to execute non-substantive amendments to the Memorandum of Understanding on behalf of the County, subject to County Counsel review.

3.                     Direct the Sheriff/Coroner/Public Administrator, Undersheriff, of Assistant Sheriff to transmit all amendments in relation to the Memorandum of Understanding to the Clerk of the Board of Supervisors within 30 days of execution.

FINANCIAL IMPACT

Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). The Superior Court of San Bernardino County will reimburse the Sheriff/Coroner/Public Administrator (Department) $18,808 for the continuation of security services at the Big Bear courthouse from July 1, 2020 through December 31, 2021.  Approval of the necessary budget adjustment are not requested at this time, but will be included on a future countywide quarterly budget report presented to the Board of Supervisors (Board) for approval, if necessary.

 

BACKGROUND INFORMATION

Government Code Section 69926(b) requires the County Sheriff, with the approval of its Board of Supervisors, to enter into a Memorandum of Understanding (MOU) with the Superior Court (Court) specifying the agreed upon level of court security services and operating procedures. The Court and the Department have maintained multiyear MOU’s for countywide court security services as approved by the Board, with the most recent approved on June 26, 2018 (Item No. 66), Agreement No. 18-381 for the period of July 1, 2018 through June 30, 2021. The Court received a grant from the Judicial Council of California (JCC) under Agreement No. 1034102 through the “Intra-Branch Agreement for the Courts Innovations Grant Program”, and part of said grant funding is designated for additional court security services to be provided by the Department at the Big Bear Courthouse.

 

On February 13, 2018 (Item No. 67), the Board approved a separate MOU (Agreement No. 18-59) with the Court which allowed the Department to provide additional services at the Big Bear courthouse as required by the JCC grant for the period of January 1, 2018 through June 30, 2020. The Department provides additional services at the location with one Deputy Sheriff for five hours, while the Court conducts video proceedings for traffic infraction arraignments and misdemeanor probation modification matters, every second and fourth Friday of the month.

 

The Department recommends extending the period for the separate MOU from July 1, 2020 through December 31, 2021, as requested by the Court. Authorizing the Sheriff/Coroner/Public Administrator, Undersheriff, or Assistant Sheriff to execute non-substantive amendments to the MOU as needed, due to unforeseen conditions, and upon review by County Counsel, will facilitate the implementation of any required minor changes to continue with the provision of services. All amendments in relation to this MOU will be transmitted by the Sheriff/Coroner/Public Administrator, Undersheriff, or Assistant Sheriff to the Clerk of the Board within 30 days of execution.
