Recommendation

Adopt resolution providing direction to the Registrar of Voters to place “The San Bernardino County Supervisor Compensation Reduction and Term Limits Initiative” on the November 3, 2020 General Election ballot.

FINANCIAL IMPACT

Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). The Registrar of Voters (ROV) estimates all costs plus overhead related to conducting the election for the initiative will be about $2.7 million. Appropriation for election costs and revenue from election fees were included in ROV’s 2020-21 budget.

 

This election cost estimate does not include potential additional costs related to compliance with COVID-19 health and safety guidelines and potential new State mandates, which could be eligible for Federal Coronavirus Aid, Relief, and Economic Security (CARES) Act Coronavirus Relief Funds if no other COVID-19 or election related federal or state funding is available.

 

BACKGROUND INFORMATION

On September 13, 2019, authorized agents for the proponent, Nadia M. Renner, filed the text of an initiative petition entitled “The San Bernardino County Supervisor Compensation Reduction and Term Limits Initiative” (Petition), a Notice of Intention to Circulate an Initiative Petition, and a request for a ballot title and summary with ROV. On March 20, 2020, the Petition was filed with ROV and on May 19, 2020 (Item No. 111), ROV certified the sufficiency of the Petition to the Board of Supervisors (Board). The Board accepted the Certification of Initiative Petition and, prior to taking any action on the ordinance, ordered a report pursuant to Elections Code section 9111 be brought back to discuss the impacts of both the compensation and term limit reductions.

 

On June 9, 2020 (Item No. 65), the report was provided to the Board, pursuant to Elections Code section 9111(b), the Board took action pursuant to Elections Code 9118(b) to submit the ordinance, without alteration, to the voters pursuant to Elections Code section 1405(a).

 

Approval of the recommended resolution will provide direction to ROV in placing the Petition on the November 3, 2020 General Election ballot, including the form of the ballot question.

 

County Counsel drafted the recommended ballot question language for the Initiative Petition/Measure contained in the resolution. Following Board approval of the resolution, Counsel will also draft an impartial analysis of the Initiative Petition/Measure.
