Recommendation

Approve Amendment No. 2 to Contract No. 15-95 A-1 with Graffiti Protective Coatings, Inc., to provide graffiti abatement services, extending the contract two months for a total contract period of February 11, 2015, through August 31, 2020, with no change to the total contract amount.

FINANCIAL IMPACT

Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost).  Sufficient appropriation is included in the Land Use Services Department (LUS) Code Enforcement Division’s 2020-21 budget.

 

BACKGROUND INFORMATION

The Code Enforcement Division of LUS is responsible for protecting the public’s safety in accordance with County ordinances, including those pertaining to public nuisance conditions, such as graffiti.  The most effective way to discourage future acts of graffiti vandalism and the spread of graffiti is by quickly removing existing graffiti. Throughout the County’s unincorporated areas, there is a need for timely graffiti abatement of 800 to 1,000 sites per month.  LUS does not have staff with the expertise or the equipment to perform graffiti abatement to a high professional standard by color matching the surface that is being painted over. Since 2015, LUS has contracted with Graffiti Protective Coatings, Inc. (GPC), to perform graffiti abatement.

 

On February 10, 2015 (Item No. 23), the Board of Supervisors (Board) approved Contract No. 15-95 with GPC to provide graffiti abatement services with an amount not to exceed $318,684, for the period of February 11, 2015, through February 10, 2018, with the option to extend for two additional one-year terms.

 

On March 28, 2017 (Item No. 29), the Board approved Amendment No. 1 to Contract No. 15-95 with GPC to continue providing graffiti abatement services, increasing the not-to-exceed amount to $754,944, and extending the expiration date from February 10, 2018 to June 30, 2020. 

 

The recommended Amendment No. 2 to Contract No. 15-95 A-1 will allow GPC to continue providing graffiti abatement services by extending the expiration date from June 30, 2020 to August 31, 2020, with no change to the total contract amount.

 

PROCUREMENT

On January 27, 2020, LUS released RFP No. LUSD20-LUS-3704 through the County’s Electronic Procurement System (ePro) to identify vendors to provide graffiti abatement services for the unincorporated areas of the County.  On April 30, 2020, a Notice of Intent to Award letter was sent to the selected vendor and denial letters were sent to the non-selected vendors.  A protest was received during the 10-day protest period.  This contract extension will enable LUS to continue to provide graffiti abatement services while the protest is being reviewed.  Upon completion of the protest review, LUS will return to the Board for approval of a new contract.
