Recommendation
Acting as the governing body of the San Bernardino County Flood Control District, approve Amendment No. 1 to Contract No. 17-576 with Amer General Engineering, Inc. increasing the total contract amount by $250,000 from $250,000 to $500,000 for heavy equipment rental services, with no change to the contract end date of June 30, 2022.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The San Bernardino County Flood Control District (District) is funded by property taxes, fee revenue, and local, state, and federal funding. The cost increases for the proposed amendment of $250,000 will be funded by one or more of the revenue sources listed above, depending on specific projects and the needs of the District. Sufficient appropriation and revenue have been included in the District’s 2020-21 budget and will be included in future recommended budgets.
BACKGROUND INFORMATION
On June 27, 2017 (Item No. 87), the Board of Supervisors (Board) approved contracts with 33 vendors to be on the District’s’ on-call heavy equipment rental services list. This item included the contract with Amer General Engineering, Inc. (Amer General) in an amount not-to-exceed $250,000 (Contract No. 17-576) for a contract term of July 1, 2017 through June 30, 2022. Expenditures for Contract No. 17-576 with Amer General are reaching the not-to-exceed amount of $250,000 due to Amer General being the lowest bidder for excavating services.
The proposed contract amendment will increase the total contract amount for Contract No. 17-576 with Amer General to allow the District to continue to receive bids from Amer General for heavy equipment rental services to be used on routine road maintenance projects, public projects not exceeding the amount identified in Public Contract Code section 22032(a) and emergency road projects (following applicable provisions of the Public Contract Code). The proposed amendment allows the District to continue to utilize Amer General for up to an additional $250,000 for specific projects on an as-needed basis. Having a list of readily accessible pre-qualified vendors available for heavy equipment rental services provides good value to the District and aligns with the County and Chief Executive Officer’s goals to provide for the safety of County residents and to operate in a fiscally-responsible and business-like manner.
All other terms and conditions of Contract No. 17-576 will remain the same.
