RECOMMENDATION(S)

Recommendation

1.                     Accept grant award agreement (State Agreement No. EA31-20-0047) from the California Department of Resources Recycling and Recovery for the Local Enforcement Agency Grant Program to support solid waste facilities permit and protection programs, in the amount of $50,902, for the period of July 1, 2020 through October 28, 2021.

2.                     Designate the Director of the Department of Public Health, as required by the California Department of Resources Recycling and Recovery and authorized via Board of Supervisors Resolution 2018-56, to execute any subsequent non-substantive grant award amendments in relation to the grant award agreement (State Agreement No. EA31-20-0047) on behalf of the County, subject to review by County Counsel.

3.                     Direct the Director of the Department of Public Health to transmit all documents and amendments in relation to this grant award agreement to the Clerk of the Board of Supervisors within 30 days of execution.

FINANCIAL IMPACT

This item does not impact Discretionary General Funding (Net County Cost).  The grant award agreement for the Local Enforcement Agency (LEA) Grant Program in the amount of $50,902 from the California Department of Resources Recycling and Recovery (CalRecycle) does not require a match.  Adequate appropriation and revenue have been included in the Department of Public Health’s (DPH) 2020-21 budget and will be included in the 2021-22 recommended budget.

 

BACKGROUND INFORMATION

CalRecycle administers a statewide program to enforce regulations pertaining to solid waste management.  It also designates a LEA to aid in enforcement activities and offers the non-competitive LEA Grant Program exclusively for the support of solid waste facilities, permit, and inspection programs.  The DPH, Division of Environmental Health Services (DEHS) will use this grant award to support the inspection of landfills, transfer stations, composting facilities, chipping and grinding operations, and construction and demolition processing facilities countywide.  DEHS, the designated LEA for San Bernardino County, has received LEA Grant Program funds since 2003.

 

On August 17, 2020, DPH received the grant award agreement (State Agreement No. EA31-20-0047) from CalRecycle, for the grant period of July 1, 2020 through October 28, 2021.  In addition to the acceptance of the grant award agreement for the LEA Grant Program to support solid waste facilities permit and protection programs, DPH is requesting approval for the DPH Director, as required by CalRecycle, to execute any subsequent non-substantive amendments to the grant award agreement, on behalf of the County, subject to review by County Counsel.  CalRecycle requires the adoption of a resolution for authority to execute all grant documents, including, but not limited to: the grant application, the agreement, any subsequent amendments, requests for payment, and final report.  On April 17, 2018 (Item No. 34), the Board of Supervisors (Board) adopted Resolution No. 2018-56 authorizing signature authority to the DPH Director for a five-year period.   

 

This item is being presented to the Board at this time, as this is the first date available for presentation following the required operational, fiscal, and legal reviews.  Approval at this time will have no impact on DEHS’ solid waste facilities permit and inspection program.
