RECOMMENDATION(S)

Recommendation

1.                     Approve Agreement with the Regents of the University of California on behalf of its UC Agriculture and Natural Resources and its UC Cooperative Extension for San Bernardino County to provide research and educational programs for the residents of San Bernardino County in the amount of $77,500 for the one-year period of July 1, 2020 through June 30, 2021.

2.                     Approve Use Permit with the Regents of the University of California on behalf of its UC Agriculture and Natural Resources and its UC Cooperative Extension for San Bernardino County for use of approximately 2,343 square feet of office and shared space, comprised of: (a) 1,556 square feet of the County-leased space located at the County Library facility at 7863 Central Avenue in Highland and (b) 787 square feet of County-owned space located at the Agriculture/Weights and Measures facility at 777 E. Rialto Avenue in San Bernardino, to operate the UC Cooperative Extension research and educational programs for the residents of San Bernardino County for no monetary fee for the one-year period of July 1, 2020 through June 30, 2021.

FINANCIAL IMPACT

Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). Pursuant to the Agreement (Program Agreement), the County of San Bernardino (County) shall pay the Regents of the University of California $77,500 for UC Cooperative Extension (UCCE) staff to provide research and educational programs. The County shall also provide UCCE staff with use of a total of 2,343 square feet of County-leased space at the County Library in Highland and County-owned space at Agriculture/Weights and Measures in San Bernardino at no monetary cost to UCCE but has an in-kind value of $66,189 for rent and County-provided utilities, maintenance, and janitorial services. The costs for the County-provided utilities, maintenance, and janitorial services for the UCCE spaces are included in the County Library and Agriculture/Weights & Measures’ 2020-21 budget. Appropriation of $77,500 for the cost of research and education programs is included in the following departments’ 2020-21 budgets:

BACKGROUND INFORMATION

The recommended Program Agreement will allow UCCE to provide UCCE Programs to various County departments and the residents of the County and the recommended Use Permit will authorize the use of a total of 2,343 square feet of County-leased space at 7863 Central Avenue in Highland and County-owned space at 777 E. Rialto Avenue in San Bernardino, each for the one-year period of July 1, 2020 through June 30, 2021. These agreements meet the stated County Goals and Objectives by providing a countywide system of community-based education that is a partnership between local County government and the University of California.

 

UCCE provides research and educational programs to county residents in the areas of food and nutrition education, gardening and horticulture, food preservation, natural resources and youth development. These agreements have a clear nexus to County departments for department-specific, outcome-based services. The County and UCCE will continue to develop services that are defined and agreed upon by the individual departments. The overall effort also includes a commitment from each department to assist with outreach to the public; the implementation of a “Program Outcomes Reporting Tool”; assistance with the creation and distribution of academic and research material; and quarterly strategy meetings to evaluate the success of the programs and to redefine and/or revise as necessary to meet the needs of the county residents.

 

UCCE was started to help farmers, homemakers, and youth by providing access to the latest university research to improve their lives. After over a century of service, UCCE continues to connect communities with the university campus, bringing practical, trusted, science-based solutions to Californians. Cooperative Extension, through the University of California’s Division of Agriculture and Natural Resources, has 57 county offices throughout the state, and nine research and extension centers.

 

On June 6, 1917, the Board of Supervisors (Board) requested by Resolution that the Regents of the University of California establish an office of the Cooperative Agriculture Extension Service in San Bernardino County to provide agriculture expertise and education to residents of the county. Since September 2009, UCCE has provided a variety of programs through annual agreements with the County. In addition, UCCE has, at least in part, delivered programs (via a Use Permit) in the County-owned facility located at 777 East Rialto Avenue in San Bernardino.  Due to the anticipated closure of the Agriculture/Weights and Measures’ district office in Ontario, County staff will need to be relocated to the County-owned space located at 777 East Rialto Avenue in San Bernardino. In 2019, the County began searching for an additional site that could accommodate UCCE staff and its programs and identified the combined available space  at the County Library in Highland and the Agriculture/Weights and Measures in San Bernardino that will meet UCCE’s needs.  The Highland Library offers 1,556 square feet which includes exclusive use of an indoor lab and office space, and non-exclusive use of a community room. The Agriculture/Weights and Measures San Bernardino location offers 787 square feet of available space, which includes exclusive use of office space and indoor/outdoor storage.

 

The Program Agreement may be terminated at any time by either party on 60 days prior written notice, which will simultaneously terminate the Use Permit. The Use Permit may be terminated in part as to the County Library space in Highlands if the County’s lease for the Highland library is terminated or terminated in its entirety due to default, but there is no right for either party to terminate for convenience. If the Use Permit is terminated in whole or in part, the Program Agreement shall continue but County shall have no obligation to provide alternate space. The Director of the Real Estate Services Department may exercise the termination right in the Use Permit on behalf of the County.    

 

The Program Agreement and the Use Permit are being presented at this time for Board approval effective as of July 1, 2020, as the terms of the Program Agreement and Use Permit were finalized on September 9, 2020 and this is the first date available for presentation following the required operational, fiscal, and legal reviews. Approval by the Board on this date will have no impact on UCCE’s services and activities.
