Recommendation
Acting as the governing body of the San Bernardino County Flood Control District:
1. Rescind approval of agreement with Santa Ana River Watershed In-Lieu Fee Program, in the amount of $963,000 for the mitigation of impacts from the First Line of Defense Basins Project (Project), approved by the Board of Supervisors on August 25, 2020, (Item No. 69, Recommendation No. 3).
2. Approve Agreement with Southwest Resource Management Association, in the amount of $963,000 for the mitigation of impacts from the Project.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The total cost of this agreement is $963,000, which will be funded by existing property tax revenue. Sufficient appropriation has been included in the San Bernardino County Flood Control District’s (District) 2020-21 budget (1910002518, 1920002522, and 1930002526) and will be included in future recommended budgets.
BACKGROUND INFORMATION
On August 25, 2020, (Item No. 69) the Board of Supervisors approved an Agreement with Santa Ana River Watershed In-Lieu Fee Program (SARWILF) for the purchase of 3.21 acres of Project mitigation credits for $963,000. Recommendation No. 3 of that Board item did not correctly identify the contracting entity, which is the Southwest Resource Management Association (SRMA). SRMA, as the cosponsor of the SARWILF, has agreed to enter into an agreement to sell to the District the 3.21 acres in Project mitigation credits for $963,000.
