RECOMMENDATION(S)
Recommendation
1. Acting as the governing body of the County of San Bernardino (County):
a. Approve agreement with the San Bernardino County Fire Protection District (SBCFPD) for the County to provide one-time funding in an amount not to exceed $300,000 and other support to SBCFPD for implementation of SBCFPD’s Re-Entry Pilot Program, with a term of the agreement from October 6, 2020 through June 30, 2021.
b. Authorize the Auditor-Controller/Treasurer/Tax Collector to post adjustments totaling $300,000, as detailed in the Financial Impact section, to the County Probation Department’s 2020-21 budget (Four votes required).
2. Acting as the governing body of SBCFPD:
a. Approve agreement with the County for SBCFPD to accept one-time funding in an amount not to exceed $300,000 and other support from the County for implementation of SBCFPD’s Re-Entry Pilot Program, with a term of the agreement from October 6, 2020 through June 30, 2021.
b. Authorize the Auditor-Controller/Treasurer/Tax Collector to post adjustments totaling $300,000, as detailed in the Financial Impact section, to SBCFPD’s 2020-21 budget (Four votes required).

FINANCIAL IMPACT
Approval of this item will not require the use of additional Discretionary General Funding (Net County Cost) as the one-time $300,000 payment from the County to SBCFPD for costs pertaining to SBCFPD’s Re-Entry Pilot Program (Program) will be funded through the use of 2011 Realignment (AB 109) revenue that was apportioned to the County Probation Department (Probation) in a prior fiscal year. The following table reflects the budget adjustments requested by Probation and SBCFPD to proceed with this one-time payment.

SBCFPD will use the $300,000 primarily to fund the cost of additional extra-help employees needed for the Program.
BACKGROUND INFORMATION
SBCFPD engages in various fire prevention activities to help mitigate the risk of destructive fires.
SBCFPD currently deploys hand crew teams, as well as inmate hand crews through a partnership with the San Bernardino County Sheriff’s Department (SBCSD), to perform firefighting and fuel reduction activities. Given the continued increase of occurrences and risks associated with fires, SBCFPD wishes to augment the hand crews/inmate hand crews by establishing a new partnership with Probation for the Program.
The Program would employ released inmates in good standing for fuel reduction and other fire related services. The Program will enhance SBCFPD’s ability to mitigate fires in the County and provide work experience for skilled individuals released from custody, which may ultimately reduce recidivism and lead to gainful employment. Under close supervision and in collaboration with SBCSD and Probation, the services provided by these individuals will help improve the safety and health of County residents threatened by fires and other disaster related incidents.
Probation and SBCSD have agreed to assist SBCFPD in the identification and selection of employment candidates who would provide SBCFPD with the aforementioned Program services. Probation has also offered to provide SBCFPD with one-time funding in the amount of $300,000 for Program costs through June 30, 2021. However, SBCFPD will be responsible for funding the cost of providing Program employees with the necessary gear and equipment.
Pursuant to the terms of the recommended agreement, Probation will advance the $300,000 to SBCFPD within ten days of Board of Supervisors/Board of Directors (Board) approval of this item. Upon SBCFPD Program completion and the capture of all SBCFPD Program costs, SBCFPD shall submit to Probation an itemized accounting of actual SBCFPD Program costs incurred by SBCFPD and, if said costs are less than the $300,000 paid by Probation, then SBCFPD shall refund Probation the difference within 60 days after issuance of the itemized accounting.
Board approval of this recommended agreement between SBCFPD and the County will allow the Program to become operational during the current fire season, which has already resulted in a California state record of over 3.7 million acres burned.
