RECOMMENDATION(S)

Recommendation

1.                     Find that the pavement reconstruction and Americans with Disabilities Act ramp improvements on Alder Avenue, from 0.08 miles south of Taylor Avenue north to San Bernardino Avenue in the Fontana area (Project) is exempt under the California Environmental Quality Act, Class 1, Section 15301(c) (existing facilities) and Class 2, Section 15302 (replacement or reconstruction).

2.                     Approve Project as defined in the Notice of Exemption and direct the Clerk of the Board to file and post the Notice of Exemption.

3.                     Approve Cooperative Agreement between the County of San Bernardino and the City of Fontana, wherein each entity will contribute $1,115,000 and $1,135,000 respectively, toward the $2,250,000 estimated cost for the Project.

4.                     Authorize the Director of Public Works to increase the County contribution amount up to 25 percent (from $1,115,000 to $1,393,750), should Project construction costs dictate such an increase.

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The County of San Bernardino’s (County) estimated share of cost of the Project will be funded with Senate Bill 1 Road Maintenance and Rehabilitation Account (RMRA) funds. The City of Fontana (City) will be responsible for its share of cost for the subject work within the City’s jurisdiction and any additional costs, up to 25 percent will be shared proportionately between County and City. Sufficient appropriation and revenue for the Project are included in the Department of Public Works (Department) 2020-21 Road Operations budget and will be included in future recommended budgets (6650002000 14H14978).

 

BACKGROUND INFORMATION

The Project involves pulverizing the existing asphalt surface, removing a portion of the pulverized material, placing cement treated base and paving with new asphalt concrete. The Project also includes updating and constructing curb ramps at various locations pursuant to the Americans with Disabilities Act (ADA). By preserving and improving the structural integrity of the existing roadway surface, the Project aligns with the County and the Chief Executive Officer’s goals to ensure development of a well-planned, balanced and sustainable County as well as working with other agencies.

In accordance with the terms of the Cooperative Agreement, the County is the lead agency in the design, survey, California Environmental Quality Act (CEQA) review and construction of the Project. The City agrees to provide the County a no-cost permit for work in the City’s right-of-way and pay its proportionate share of the Project’s cost. Unless terminated prior to the award of the construction contract, the Cooperative Agreement terminates upon completion of the Project and payment by City, or December 31, 2023, whichever occurs first. The City approved the Cooperative Agreement on October 27, 2020.

 

Environmental staff of the Department has reviewed this Project and has determined that a categorical exemption in accordance with the CEQA Guidelines, Title 14 of the California Code of Regulations, Section 15301 (c) and Section 15302 is appropriate. This exemption allows for minor alterations, repair, and maintenance of existing public facilities and structures that involve negligible or no expansion of an existing use, including highway and street improvements.

 

PROCUREMENT

The Department anticipates returning to the Board of Supervisors for approval of the Project plans and specifications in Winter 2020 and construction is anticipated to commence in Spring 2021.
