RECOMMENDATION(S)

Recommendation

Approve agreements with Kallen Family Revocable Living Trust and Juan & Janice Vasquez 199 Revocable Trust (Subdivider) to guarantee the construction of road and drainage improvements and accept the performance and labor and material securities, as listed in the Financial Impact section, for the construction of the required improvements for Parcel Map 19991, consisting of four parcels located at the corner of Deep Creek Road and Rock Springs Road Street in the Apple Valley area.

FINANCIAL IMPACT

Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). This item will ensure the construction and warranty of the required infrastructure for the project.

BACKGROUND INFORMATION

The recommended securities and agreement for Parcel Map 19991 will ensure the construction and warranty of the road and drainage improvements required for development of the site. Pursuant to the California Subdivision Map Act, the Subdividers are required to guarantee construction of infrastructure required for development of the subdivision. In order to record Parcel Map 19991 in advance of construction of the subdivision improvements, the Subdivider may enter into an agreement with the County to guarantee construction, in compliance with County Development Code section 87.07.040 and the Subdivision Map Act (Government Code sections 66462 and 66499). In the agreement, the Subdivider agrees to furnish the equipment, labor and material necessary to complete the required road and drainage improvements within the time specified in the agreement (two years). 

 

The Land Use Services Department (LUS) is satisfied that the secured amounts for road and drainage improvements are sufficient to complete construction of the required improvements.

 

The road and drainage performance securities will be held until the Subdivider completes construction of the required improvements and the Board of Supervisors (Board) or the Chief Executive Officer (CEO) accepts the construction. The road and drainage labor and material securities will be held until the Board or the CEO accepts construction of the improvements and LUS verifies that no liens have been filed with the Clerk of the Board.
