Recommendation

Approve Contract with Medtronic USA, Inc. for the contract period of November 18, 2020 through December 31, 2021, for an amount not-to-exceed $450,000, for the purchase of Stealth Station™ System’s compatible Ventriculo Peritoneal Shunts, Catheters and Neurological Accessories.

FINANCIAL IMPACT

Approval of this recommendation will not result in the use of Discretionary General Funding (Net County Costs) as the not-to-exceed amount of $450,000 is funded by State Medi-Cal, Federal Medicare, private insurances and other departmental revenues.  Funding sources may change in the future pending any legislative activity related to the repeal and/or replacement of the Affordable Care Act.  Adequate appropriation and revenue have been included in the Arrowhead Regional Medical Center (ARMC) 2020-21 budget and will be included in future recommended budgets.

 

BACKGROUND INFORMATION

Approval of this item will allow ARMC to purchase surgical accessories specifically compatible with the Stealth Station system.  The Stealth Station™ System is intended as an aid in locating anatomical structures with open procedures and those performed through the skin.  The Stealth Station™ is used for medical conditions in which the surgery requires investigating accurate positioning of probes based on three-dimensional diagrams, and in reference to rigid anatomical structures such as the skull and along bone.  The purchase of these Stealth Station™ System compatible ventriculo peritoneal shunts, catheters and neurological accessories provide for the safety, health, and social service needs of the County residents by ensuring that surgeries that require precise locating of the anatomy and probe positioning can be optimally performed. 

 

The Contract with Medtronic USA, Inc. is its standard commercial contract with terms negotiated by the parties, including the following non-standard term:

 

Limitations of Liability  

Medtronic USA, Inc. is not liable to the County for lost profits, cost of cover, or any other special, incidental, consequential, or reliance damage with respect to the use, loss of use, or the practices of the County.

                     The standard County contract contains no limitations of liability.

                     The County is waiving the right to recover the specified damages at issue.  If the County sustains any such damages, the County would be financially responsible for such damages.

 

ARMC recommends approve of the contract, including the non-standard terms as it will allow ARMC to purchase vital medical equipment and materials to provide medical care to its patients.

 

PROCUREMENT

This purchase is non-competitive as Medtronic USA Inc.’s Stealth Station™ System with required components and accessories are proprietary in nature.

 

Purchasing supports this non-competitive procurement.
