Recommendation

Adopt resolution appointing candidates in lieu of election for certain contests in the 2020 Presidential General Election where no person filed a Declaration of Candidacy.

FINANCIAL IMPACT

Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost) as the adoption of a Resolution for Appointment in Lieu of election is non-financial in nature, and appropriation for the minimal staffing required was included in the 2020-21 Registrar of Voters’ budget.

 

BACKGROUND INFORMATION

California Elections Code section 10515 requires that when the number of candidates who file for an office is less than or equal to the number of offices to be filled, the Board of Supervisors (Board) shall appoint those candidates to the office. When no person files for an office, the Board shall appoint a qualified person to fill that office. All persons appointed in lieu of election by the Board shall serve to the end of the term.

 

On October 27, 2020, the Board adopted Resolution No. 2020-189 to appoint 40 candidates in lieu of election to fill offices that were up for election in various special districts in the 2020 Presidential General Election. These 40 candidates filed a Declaration of Candidacy, but there were not enough candidates for each special district office to hold an election.

 

No eligible voters filed a Declaration of Candidacy for 24 additional offices in 12 special districts in the First, Second, and Third Supervisorial Districts. Adoption of this Resolution will appoint 19 eligible voters, in lieu of election, as Members of the Board of Directors for nine independent special districts for two-year and four-year terms that start December 4, 2020. The First, Second and Third District Supervisors recommended these candidates for Board approval.

 

This action does not complete the appointments in lieu of election for the 2020 Presidential General Election. Five offices remain unfilled for the Board to appoint eligible voters. Recommended appointments to these offices will be presented to the Board for approval at a future meeting.

 

Pursuant to Elections Code section 10507, the current officeholders will continue to serve on these special district Board of Directors until a successor is appointed by the Board and takes office.
