RECOMMENDATION(S)
Recommendation
1. Find that the pavement rehabilitation on Beech Avenue and Hemlock Avenue, in the Fontana area (Project) is exempt under the California Environmental Quality Act, Class 1, Section 15301(c) (existing facilities).
2. Approve Project as defined in the Notice of Exemption and direct the Clerk of the Board to file and post the Notice of Exemption.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The Department of Public Works (Department) is funded by Gas Tax revenue, fees and other state and local funding. The requested actions are administrative in nature with minimal financial impact. Sufficient appropriation is included in the Department’s 2020-21 Road Operations budget (6650002000 14H14977).
BACKGROUND INFORMATION
The Project will be constructed in two phases. The first phase is located on Beech Avenue, from Fontana Avenue to Randall Avenue, and involves milling the existing pavement and overlaying the roadway with new asphalt concrete, construction of new asphalt concrete dike and minor roadway widening at various locations to improve drainage, replacing curb and gutter, and reconstructing curb ramps at various locations, in accordance with current design standards and pursuant to the Americans with Disabilities Act (ADA), as well as repairing or reconstructing spandrels and cross-gutters. All work for this phase of the Project will be done within the existing road right-of-way.
The second phase is located on Beech Avenue, from Randall Avenue to Muscat Avenue, and on Hemlock Avenue, from Fontana Avenue to Ceres Avenue, and involves pavement reconstruction, roadway widening, reconstruct and construct ADA curb ramps, right-of-way acquisitions and utility relocations.
The Department’s Environmental staff reviewed this Project and determined that a categorical exemption in accordance with the California Environmental Quality Act (CEQA) Guidelines, Title 14 of the California Code of Regulations, Section 15301 (c) is appropriate. This exemption allows for the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use. When the Board considers the environmental finding, the filing and posting of a Notice of Exemption is recommended.
This Project aligns with the County and Chief Executive Officer’s goals of ensuring development of a well-planned, balanced, and sustainable County and providing for the safety of County residents by preserving and improving the structural integrity of existing road surfaces and improving access for all pedestrians, including those with disabilities.
PROCUREMENT
The Department anticipates bringing the first phase of the Project’s plans and specifications, as well as a recommendation to advertise for competitive bids to the Board for consideration in January 2021, with the bid opening in February 2021, and the award of contract in March 2021.
