Approve Cooperative Agreement with the State of California Department of Transportation (Caltrans) (Caltrans Agreement No. 07-5045) for compensation, in the amount of $671,000 for use of County of San Bernardino Maintained Roads in the unincorporated area of Phelan as detour roads during the Caltrans’ bridge rehabilitation project on State Route 18 in the Phelan area.

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). Caltrans, upon execution of the subject Cooperative Agreement (Agreement), will compensate the County of San Bernardino (County) a total amount of $671,000 for use of County Maintained Roads as detour roads during its bridge rehabilitation project on State Route (SR) 18 in the Phelan area, subject to programming of the reimbursement funds by the California Transportation Commission (CTC). Funds will be deposited into the Department of Public Works (Department) Transportation budget (6650002000 H15102) for use on future road maintenance.

 

BACKGROUND INFORMATION

Caltrans previously rehabilitated the bridge on SR 18 and during the construction period of February 2015 through March 2017, portions of SR 18 were closed and traffic was detoured onto Oasis Road, between SR 138 and SR 18, and Phelan Road, between SR 138 and Los Banos Avenue. Caltrans also installed signage and striping on these two detoured roads. Caltrans is authorized under California Streets and Highways Code (SHC) Section 93 to construct, maintain, and direct State Highway traffic onto detour roads as necessary to facilitate movement of traffic where State Highways are closed or obstructed by construction or otherwise.

 

Additionally, SHC Section 93 provides that if requested by a local agency, Caltrans shall restore the local roads to the former condition and shall reimburse the local agency for all reasonable additional expenses incurred in maintaining said roads during the period of the detour if such additional expenses were caused by the detour.

 

Caltrans and the Department staff met and discussed to determine the compensation and Caltrans agrees to provide the County $671,000 for Caltrans use of the County’s Maintained Roads during its bridge rehabilitation project on SR 18 in the Phelan area. Upon approval of the Cooperative Agreement by both agencies, the Department will submit an invoice to Caltrans in the amount $671,000 as compensation for the use of County roads. Supplemental funds needed for the bridge rehabilitation project’s budget to provide the County’s compensation have not yet been programmed by the CTC. However, Caltrans and the County agree to proceed with this Agreement subject to the programming of those funds by the CTC at a future CTC meeting.

 

The item meets the County and Chief Executive Officer’s goals and objectives by operating in a Fiscally-Responsible and Business-Like Manner by ensuring that the County is compensated for traffic impacts to the roadway during the Caltrans project.
