Recommendation

Acting as the governing body of the San Bernardino County Flood Control District, approve Amendment No. 1 to Common Use Agreement No. 17-103 with the City of Fontana to include portions of East Etiwanda Creek Channel in the recreational multi-use community trails system.

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The San Bernardino County Flood Control District (District) costs associated with this amendment are limited to administrative costs related to the approval of this amendment. Development, operation, and maintenance of the East Etiwanda Creek Channel in the recreational multi-use community trails system (Trail Segment) will be financed solely by the City of Fontana (Fontana). Although the District will not receive a fee from Fontana under the proposed Amendment No. 1 to the Common Use Agreement No. 17-103 (CUA), the District will benefit from improved access roads and reduced maintenance costs in the area of common use. Sufficient appropriation is included in the District’s 2020-21 budget (1910002518).

 

BACKGROUND INFORMATION

On February 14, 2017 (Item No. 85) the Board of Supervisors approved the CUA between the District and Fontana under which Fontana may use portions of the District’s right-of-way in the San Sevaine Channel for recreational multi-use community trails. 

 

Fontana and the City of Rancho Cucamonga are working in coordination and cooperation, with Fontana taking lead, to construct a trail segment from the Pacific Electric Trail in Fontana’s jurisdiction north to Banyan street in the City of Rancho Cucamonga’s jurisdiction. The proposed Amendment No. 1 will include Fontana’s portion of the Trail Segment, an approximately 0.35 mile length along the west side of the District’s East Etiwanda Creek Channel, from the Pacific Electric Trail to the I-15 Freeway; the remaining length from the I-15 Freeway to Banyan Street will be covered in a separate agreement. The Trail Segment will connect the Pacific Electric Trail and the San Sevaine Trail.

 

Accommodating the Trail Segment within the District’s right-of-way will support the County and Chief Executive Officer’s goals to ensure development of a well-planned, balanced and sustainable County, as well as to pursue County goals and objectives by working with other agencies.

 

Amendment No. 1 will benefit the District by improving access roads and reducing maintenance costs in the area of common use. Development, operation, and maintenance of Fontana’s trail system will be at Fontana’s sole expense.

 

The Fontana City Council approved Amendment No. 1 for the Trail Segment at its regular meeting on February 10, 2021. The term of the CUA remains unchanged from February 14, 2017 to February 14, 2037. Either party may terminate the CUA at any time with one year notice prior to the expiration of the CUA.
