RECOMMENDATION(S)
Recommendation
1. Approve the Final 2021-22 U.S. Department of Housing and Urban Development Annual Action Plan in the amount of $11,532,072 under the Community Development Block Grant, HOME Investment Partnerships Act and the Emergency Solutions Grant.
2. Direct Community Development and Housing staff to submit the 2021-22 Annual Action Plan to the U.S. Department of Housing and Urban Development, including any comments received during the public comment process.
3. Approve delegation of signature authority as required by the U.S. Department of Housing and Urban Development for federal Community Planning and Development grants from the U.S. Department of Housing and Urban Development to the Community Development and Housing Agency Deputy Executive Officer or the Director of Community Development and Housing.
4. Authorize the Chief Executive Officer or Director of Community Development and Housing upon award from the U.S. Department of Housing and Urban Development, after review and approval of County Counsel to accept the grants, to sign the grant agreement and all other subsequent documents related to the acceptance of the grant; and,
5. Direct the Chief Executive Officer or the Director of Community Development and Housing to transmit all documents and amendments in relation to this grant award to the Clerk of the Board of Supervisors within 30 days of execution.

FINANCIAL IMPACT
This item will not result in the use of Discretionary General Funding (Net County Cost). The County of San Bernardino's (County) 2021-22 U.S. Department of Housing and Urban Development (HUD) grant allocation is $11,532,072; $7,389,880 is for Community Development Block Grant (CDBG) (which includes the allocation for both the County and participating cities), $3,508,906 for HOME Investment Partnerships Act (HOME), and $633,286 for Emergency Solutions Grant (ESG) programs. Throughout the Program Year (PY), other resources may become available to spend on eligible CDBG, HOME and ESG activities, such as program income and/or de-obligated or uncommitted funds.
BACKGROUND INFORMATION
The HUD Annual Action Plan is the formal grant application to HUD each year and is predicated upon the affordable housing, community and economic development strategies and priority needs for eligible uses of CDBG, HOME and ESG outlined in the County’s HUD Consolidated Plan (ConPlan).
The areas served under this Annual Action Plan are the unincorporated areas of the County and the 13 participating cities. These cities are Adelanto, Barstow, Big Bear Lake, Colton, Grand Terrace, Highland, Loma Linda, Montclair, Needles, Redlands, Twentynine Palms, Yucaipa, and the Town of Yucca Valley. For the purpose of these grant funds, this area is referred to as the "County Participating Cities Program”. In addition, the cities of Chino Hills, Rancho Cucamonga and San Bernardino have been approved by HUD to participate in the County's HOME Program Consortium.
On April 20, 2021 (Item No. 63), the Board of Supervisors (Board) conducted a public hearing about the Proposed 2020-21 Annual Action Plan and directed staff to return on May 4, 2021, with the final 2021-22 Annual Action Plan for consideration by the Board prior to the plan’s submittal to HUD.
To accept the federal grant funds on the behalf of the County, it is recommended that the Board approve the 2021-22 Annual Action Plan and direct Community Development and Housing (CDH) to submit this plan to HUD by May 15, 2021.
Delegate Signature Authority as Required by HUD
Periodically, the signature authority for the HUD Community Development and Planning (CPD) grants is reviewed and updated. This action delegates signature authority to the Community Development and Housing Agency (CDHA) Deputy Executive Officer or the Director of CDH for the administration and implementation of CPD grants from HUD. Any change to the signature authority requires a formal Board action.
The County receives annual allocations from HUD for CDBG, HOME and ESG funding. These grants are entitlement grants appropriated by Congress to local governmental entities which are implemented by the CPD Division of HUD. HUD requires local governing bodies to delegate signature authority to a staff member(s) in order to administer/implement grants in an efficient and effective manner. This signature authority includes but is not limited to the signing of documents relating to HUD Certifications; SF-424 Forms; Consolidated/Annual Action Plans; Consolidated Annual Performance and Evaluation Reports (CAPER); Environmental Assessments; computerized software programs such as Integrated Disbursement and Information Systems (IDIS) and Disaster Recovery Grant Reporting (DRGR); various other HUD reports, correspondence and related documents as required by HUD.
CDH will continue to submit any regional policy and planning documents (including any substantial amendments of these documents) to the Clerk of the Board for public review 30 days prior to their consideration by the Board of Supervisors.
