RECOMMENDATION(S)

Recommendation

Acting as the governing body of the San Bernardino County Fire Protection District, approve agreement with Clean Earth Environmental Solutions, Inc. to provide countywide household hazardous waste disposition services in the amount not to exceed $2,300,000 for the period of July 1, 2021 through June 30, 2026.

FINANCIAL IMPACT

Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). The Household Hazardous Waste Program (Program) is funded through city contracts, grants, a Memorandum of Understanding with the County’s Solid Waste Management Division for environmental mitigation, residential special assessment taxes collected in the unincorporated areas of the County, and other revenue generated by the program.  Appropriation for this agreement, and related revenue, are included in the San Bernardino County Fire Protection District’s (SBCFPD) 2021-2022 Recommended Budget and will be included in future year budgets.  

 

BACKGROUND INFORMATION

SBCFPD operates a Regional Household Hazardous Waste (HHW) Collection Program throughout San Bernardino County that includes one San Bernardino Central Processing Facility, 13 fixed HHW collection sites, one Antifreeze, Batteries, Oil and Latex Paint (ABOP) facility, and 4-6 one-day collection events held in both the cities and unincorporated areas.  All HHW generated from these collection facilities and one-day collection events is consolidated at the Program’s central facility located at the San Bernardino International Airport.  At this facility, waste and recyclable materials are packaged by HHW staff using United States Department of Transportation approved containers and prepared for transportation to recycling/disposal facilities located outside California.

 

SBCFPD does not have the capability for HHW national bulk transport, permanent disposition of HHW, and recycling of HHW. Consequently, SBCFPD has historically contracted for HHW disposition services. Contracting for these services provides for the safety of County residents by ensuring that the compliant disposal of HHW is occurring in the County of San Bernardino.

 

The current contract with Clean Earth Environmental Solutions, Inc. (formerly Stericycle Environmental Solutions, Inc.) for HHW disposition services will terminate on June 30, 2021. This recommended contract with Clean Earth Environmental Solutions, Inc. is for five years and will be effective from July 1, 2021 through June 30, 2026.  However, either party may terminate this agreement, for any reason, with 30 days written notice. 

 

PROCUREMENT

On November 10, 2020, Request for Proposals (RFP) bid No. RPD121-OFM-4038 was advertised through the County’s Electronic Procurement Network (ePro) seeking proposals from qualified vendors to provide for the disposition of household hazardous waste. The RFP was sent to all applicable vendors within the ePro system. The following four vendors responded to this RFP:

                     ACT Enviro (San Jose, CA)

                     Clean Earth Environmental Solutions, Inc. (Los Angeles, CA)

                     Clean Harbors (Rancho Dominguez, CA)

                     Heritage (Signal Hill, CA)

 

An evaluation committee comprised of staff from SBCFPD Office of the Fire Marshal and the City of Rancho Cucamonga reviewed the proposals received in response to the RFP. The criteria used to evaluate included proposal requirements, technical review, qualifications, experience, cost, and references. The evaluation committee recommends Clean Earth Environmental Solutions, Inc., for this contract based on their proposal providing the best value and service for SBCFPD. The other three vendors that submitted proposals were notified of this selection, with no formal protests being received.
