RECOMMENDATION(S)

Recommendation

1.                     Award a construction contract to Vance Corporation (Bloomington, CA) in the amount of $869,821.26 for the Sunburst Avenue Class I Bike Path and Class II Bike Lane Project in the Joshua Tree Area.

2.                     Authorize a contingency fund of $86,982 for the Sunburst Avenue Class I Bike Path and Class II Bike Lane Project in the Joshua Tree Area.

3.                     Authorize the Director of the Department of Public Works to approve the expenditure of the contingency fund of $86,982 for verified quantity overruns for this unit priced construction contract.

4.                     Authorize the Director of the Department of Public Works to order any necessary changes or additions in the work being performed under the contract for a total amount not-to-exceed $55,991 of the $86,982 contingency fund, pursuant to Public Contract Code section 20142.

5.                     Authorize the Director of the Department of Public Works to accept the work when 100% complete and execute and file the Notice of Completion.

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost).  The Department of Public Works (Department) is funded by Gas Tax revenues, fees, and other state and local funding. The Sunburst Avenue Class I Bike Path and Class II Bike Lane project, from State Route 62 to Calle Los Amigos, in the Joshua Tree area (Project) construction cost of $869,821.26 and any use of the proposed contingency fund will be fully funded by the following revenue sources: County Senate Bill 1 (SB1) Road Maintenance Rehabilitation Account (RMRA) revenue for the local match requirement for the Class I bike path reconstruction; Active Transportation Program Cycle 3 funds for the Class II bike lanes; San Bernardino County Transportation Authority (SBCTA) Transportation Development Act (TDA) Article 3 grant revenue for the Class I bike path reconstruction; and Gas Tax revenue  for the Class II bike lane extension to State Route 62. Sunburst Avenue is a County Maintained Road and all proposed improvements are within County jurisdiction. Sufficient appropriation and revenue are included in the Department’s Road Operations (6650002000 20H14975, 20H14976, and 20H15095) 2021-22 recommended budget. 

 

 

 

BACKGROUND INFORMATION

The Project consists of three sub-projects funded by different funding sources: 1) reconstructing the existing Class I bike path located along the east side of Sunburst Avenue from State Route 62 to Oleander Avenue (approximately 0.5 miles);  2) constructing a new Class II bike lane on the east side of Sunburst Avenue from termination of the existing Class I bike path (Oleander Avenue) north to Calle Los Amigos (approximately 1.5 miles); and 3) constructing a new Class II bike lane on the west side of Sunburst Avenue from State Route 62 to Calle Los Amigos (approximately 2 miles). Originally, the plan was to improve the Class I bike path and provide Class II bike lanes on each side of the road to the end of the Class I bike path. After grant funding was awarded, the Department decided it would be prudent to extend the Class II bike lanes on the west side of the road to State Route 62 to eliminate having to cross the street to access the Class I bike path. The Project will provide increased pedestrian and cyclist safety for students and local residents in the area and to the new Joshua Tree Elementary School. The Project was selected among the list of prioritized County projects identified in the San Bernardino County Non-Motorized Transportation Plan, which is the master plan for non-motorized infrastructure administered by the SBCTA on behalf of, and consultation with, the County and the 24 incorporated cities.

 

The Project aligns with the County and Chief Executive Officer’s goals and objectives to ensure the development of a well-planned, balanced, and sustainable County and maintaining public safety by constructing dedicated bike lanes. 

 

On January 9, 2018 (Item No. 24), the County Board of Supervisors (Board) authorized acceptance of SBCTA TDA Article 3 grant funds to reconstruct the existing Class I bike path on Sunburst Avenue, which required a local match funded by SB1 RMRA revenue, which was included in the 2017-18 SB1 RMRA project list approved by the Board on December 19, 2017 (Item No. 40).

 

On April 17, 2018 (Item No. 38), Board authorized acceptance of ATP Cycle 3 Augmentation funds to widen Sunburst Avenue and install Class II bike lanes. No local match was required.

 

On December 17, 2019 (Item No. 41), the Board adopted the Mitigated Negative Declaration which indicates this Project will not have a significant effect on the environment.  Mitigation measures to be implemented during construction include biological and archeological monitoring.  

 

Following Board approval of this item, construction is anticipated to commence the end of July of 2021 and be completed by end of September of 2021.

 

PROCUREMENT

On March 2, 2021 (Item No. 38), the Board approved the Project’s plans and specifications, as well as authorized the Director of the Department to advertise the Project for bids.  This Project was advertised in the Daily Press on March 30, 2021, in the Precinct Reporter on April 1, 2021, and released on the County Electronic Procurement Network (ePro) on March 30, 3021.  Notice inviting bids was also provided to specified construction trade journals as required by Public Contract Code section 22036. On May 6, 2021, the following four bids were received:

The Department has reviewed the bids received and determined that they are responsive, and recommends entering into a contract with Vance Corporation, the lowest responsible bidder.  No appeal/protest letters were received.

 

This Project will have a 10 percent contingency fund of $86,982 to compensate the contractor for verified quantity overruns, as well as changes in the contract under certain circumstances.  Under an established formula based on the contract amount, Public Contract Code section 20142 allows the Board to authorize the Director of the Department to order changes in the contract, including for unforeseen conditions or design shortfalls, should they become necessary in the future, for a total amount not-to-exceed $55,991 of the $86,982 contingency fund.
