Recommendation

Authorize the Auditor-Controller/Treasurer/Tax Collector to post appropriation adjustments to the Community Development and Housing Agency’s 2021-22 budget, for the Bloomington III - Ayala Park Project, as detailed in the Financial Impact section (Four votes required).

FINANCIAL IMPACT

Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). Bloomington Recreation and Park District (BRPD) under Department of Public Works - Special Districts (DPW-SD) is relocating Ayala Park (Park), and Community Development and Housing (CDH) is a partner in the Park Relocation Project (Project).  It was originally planned that each department would pay its source of funds directly to the Bloomington Park Developer, LLC, the Park Developer (Developer). CDH and DPW-SD recently decided that DPW-SD would transfer its source of funds to CDH to manage payments for the remainder of the Project. The requested budget action is not resulting from a change to the total cost of the Park Project, but will allow CDH to have sufficient appropriation to authorize expenditures to the Developer to finalize the construction of the Park.

 

Approval of the Recommendation authorizes the Auditor-Controller/Treasurer/Tax Collector to post the following budget adjustments necessary to authorize expenditures:

BACKGROUND INFORMATION

The community of Bloomington was identified as an investment and revitalization opportunity area as part of the Board of Supervisors' (Board) vision to revitalize the unincorporated areas of the San Bernardino County (County). Revitalization efforts included adoption of the Valley Corridor Specific Plan (VCSP). VCSP encourages opportunities for healthier living, including pedestrian-oriented activity centers that highlight Bloomington's cultural, historical, and community assets. To further the VCSP vision, the County has designed the third phase of the Bloomington Affordable Housing Development, which includes the relocation of Ayala Park (Park). The recommended action will assist in the completion of the newly relocated Park.

 

Bloomington Recreation and Park District, DPW-SD and CDH each secured funding for the Park.  It was contemplated that each department would pay its source of funds directly to the Developer, with CDH expending its source of funds first. Recently, CDH and DPW-SD decided that DPW-SD would transfer its source of funds to CDH, and CDH would manage payments for the remainder of the project that was previously anticipated to be completed by June 2021. The Developer has experienced unforeseen delays with the materials manufacturer, which has caused a delay to the construction delivery schedule of the project, moving the project into the 2021-2022 budget with the anticipated completion date of September 2021.    

 

On October 16, 2018 (Item No. 22), the Board approved a Development Services Agreement (Agreement No. 18-760) with the Park Developer in the amount of $635,000 for design and land use approvals for the Park.

 

On December 10, 2019 (Item No. 53), the Board approved Amendment No. 1 to Agreement No. 18-760, increasing the contract amount by $4,745,000 (from $635,000 to $5,380,000), which allowed Park Developer to proceed with construction of the Relocation Project. Amendment No. 1 also added Bloomington Recreation Park District as a signatory to the agreement.

 

On November 17, 2020 (Item No. 93), the Board approved Amendment No. 2 to Agreement No. 18-760, increasing the contract amount by $710,000 (from $5,380,000 to $6,090,000), and a Memorandum of Understanding (County Contract No. 20-1124) with Fontana  Water Company, whereby Fontana Water Company would provide $415,000 (a portion of the $710,000 contract increase) for water efficient landscape and irrigation costs that are part of the development services agreement which allowed Park Developer to proceed with construction of the Relocation Project.

 

On May 18, 2021 (Item No. 98) the Board approved Amendment No. 3 to Agreement No. 18-760 between the County of San Bernardino, Bloomington Park Developer, LLC and the Bloomington Recreation and Park District. Amendment No. 3 extended the term of the contract from July 1, 2021 to March 13, 2022, for a total contract term of October 16, 2018 to March 13, 2022, with no change to the contract amount, for the completion of the Park.
