RECOMMENDATION(S)

Recommendation

Acting as the governing body of County Service Area 70 S-7 Lenwood (CSA 70 S-7):

1.                     Find that the CSA 70 S-7 Sewer Connection Project located in Lenwood is exempt under the California Environmental Quality Act Guidelines, Section 15303, Class 3(d), New Construction or Conversion of Small Structures.

2.                     Approve a Capital Improvement Project in the amount of $65,000 for the CSA 70 S-7 Sewer Connection Project (Project).

3.                     Authorize the Auditor-Controller/Treasurer/Tax Collector to post 2021-22 budget adjustments, as indicated in the Financial Impact section, for the Project (Four votes required).

4.                     Direct the Clerk of the Board of Supervisors to file and post the Notice of Exemption for the Project as required under the California Environmental Quality Act.

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost) as the Project will be funded entirely by CSA 70 S-7 through funds available in its Capital Replacement Reserve Fund.  Since the Project was not included in the 2021-22 budget, the following budget adjustments are needed:

BACKGROUND INFORMATION

On November 20, 2001 (Item No. 78), the Board of Supervisors (Board), acting as the governing body of CSA 70 S-7, adopted a resolution to levy assessments and order the construction of a new sewer system to replace individual septic systems within the community of Lenwood.  The project to abandon all septic tanks and connect each property to the newly installed sewer main pipeline was substantially completed on April 1, 2005.  However, the San Bernardino County Department of Public Works, Special Districts Water and Sanitation Division (Special Districts) recently determined that three properties within CSA 70 S-7 were not connected to the sewer system.  Approval of this item will allow Special Districts to procced with the Project to properly abandon the three septic tanks and connect the three homes to the CSA 70 S-7 sewer system.

 

Special Districts has conducted a full review of the Project requirements and scope of work. As evidenced by the Notice of Exemption, Section 15303 of California Environmental Quality Act (CEQA) Guidelines provides categorical exemption for projects involving Class 3, new construction. All work involved in the Project is consistent with Class 3(d) exemptions, which allows for “…Water main, sewage, electrical, gas, and other utility extensions, including street improvements, of reasonable length to serve such construction”. Therefore, it is recommended that the Board find the Project to be categorically exempt from further review under Section 15303, Class 3(d), of the CEQA Guidelines (Title 14, California Code of Regulations), as well as authorize the Clerk of the Board to file and post the Notice of Exemption.

 

PROCUREMENT

Upon Board approval of this item, Special Districts will proceed with soliciting competitive bids for the Project.  Recommendation for award of the construction contract will be to the contractor providing the lowest responsive and responsible bid.
