RECOMMENDATION(S)
Recommendation
Acting as the governing body of the San Bernardino County Fire Protection District:
1. Declare the 1999 KME Type 1 Firetruck (Equipment No. 18318/VIN 1K9AF4286YN058097) as surplus property that no longer meets the needs of the San Bernardino County Fire Protection District since this vehicle exceeds the recommended age and mileage parameters for useful life set forth by the San Bernardino County Fire Protection District, Division of Vehicle Services.
2. Approve Amendment No. 1 to Agreement 20-595 with the Colorado River Indian Tribes for the transfer of surplus property listed in Recommendation No. 1, which is fully depreciated and has an estimated value of approximately $5,000, to the Colorado River Indian Tribes in consideration for a transfer of all liability and costs associated with the surplus property and for use in providing fire protection and basic life support services to the Community of Big River.
3. Authorize the Director of the San Bernardino County Fleet Management Department to execute all necessary documentation for transfer of title of surplus property identified in Recommendation No. 1.

FINANCIAL IMPACT
Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost) as there are no costs involved with the transfer of this San Bernardino County Fire Protection District (SBCFPD) surplus vehicle to the Colorado River Indian Tribes (CRIT). This vehicle is fully depreciated, presently out of service, and no longer meets the needs of SBCFPD. All SBCFPD liability and costs pertaining to the surplus property will be released and transferred to CRIT.
BACKGROUND INFORMATION
On July 14, 2020 (Item No. 59), the SBCFPD Board of Directors (Board) approved Agreement No. 20-595 (Fire Services Agreement) with CRIT that allows CRIT to provide fire protection and basic life support services to the San Bernardino County unincorporated community of Big River for the period of July 14, 2020 through June 30, 2025. Due to the proximity of the CRIT Fire Department to Big River, SBCFPD determined that these services would be more cost effective and response times would be improved if they were provided by CRIT rather than continuing with the use of SBCFPD Paid-Call Firefighters. The Fire Services Agreement further specifies that CRIT will use its own stations to provide agreement services and that SBCFPD will not provide any stations to CRIT.
Per California Government Code section 55632, SBCFPD is authorized to contract with any neighboring local agency, including CRIT, for the furnishing of fire protection services. In addition, Government Code section 6500 et seq. authorizes SBCFPD and CRIT to enter into an agreement to jointly exercise any powers common to them.
Although CRIT has the requisite resources and experience needed to provide fire protection and basic life support services, the transfer of SBCFPD surplus property, as identified in Recommendation No. 1, is essential for CRIT to provide a higher standard of service to areas including Big River, CA Highway 62, and CA Highway 95 north of Vidal Junction. This vehicle will be used to protect property throughout Big River and surrounding areas as provided in Agreement No. 20-595. Although CRIT is financially unable to purchase a new unit, they are capable of making the necessary repairs to the surplus vehicle so that it is serviceable. This transfer of surplus property will benefit the citizens and travelers in and around the Big River area.
Amendment No. 1 to Agreement No. 20-595 will transfer the surplus property listed in Recommendation No. 1 to CRIT for use in the area it covers under the Fire Services Agreement. In the event that Agreement No. 20-595 terminates early, CRIT will be required to pay SBCFPD $5,000 for the surplus property. All other terms of the contract shall remain the same.
