RECOMMENDATION(S)

Recommendation

1.                     Acting as the governing body of the San Bernardino County Fire Protection District:

a.                     Declare the following assets as surplus property that no longer meet the needs of the San Bernardino County Fire Protection District:

i.                     2007 Playcraft Boat (Equipment No. 003012/VIN PLF95634E707), which is fully depreciated and has an estimated value of approximately $2,000.

ii.                     2007 Bear Trailer (Equipment No. 035300/VIN 41YAB292472024502), which is fully depreciated and has an estimated value of approximately $3,000.

b.                     Approve agreement with San Bernardino County for the transfer of surplus assets (Equipment Nos. 003012 and 035300) identified in Recommendation Number 1.a. to the San Bernardino County Sheriff/Coroner/Public Administrator’s Department, at no cost, in consideration of the assets being used by the San Bernardino County Sheriff/Coroner/Public Administrator’s Department marine enforcement teams in preventing criminal activity, providing public safety, and supporting the San Bernardino County Fire Protection District during water rescues and recovery, and with the San Bernardino County Fire Protection District receiving indemnity and a full release of liability for the assets.

c.                     Authorize the Director of the San Bernardino County Fleet Management Department to execute all necessary documentation for transfer of title of surplus assets identified in Recommendation Number 1.a.

2.                     Acting as the governing body of San Bernardino County:

a.                     Approve agreement with the San Bernardino County Fire Protection District for the transfer of surplus assets (Equipment Nos. 003012 and 035300) identified in Recommendation Number 1.a. to the San Bernardino County Sheriff/Coroner/Public Administrator’s Department, at no cost, in consideration of the assets being used by the San Bernardino County Sheriff/Coroner/Public Administrator’s Department marine enforcement teams in preventing criminal activity, providing public safety, and supporting the San Bernardino County Fire Protection District during water rescues and recovery, and with the San Bernardino County Fire Protection District receiving indemnity and a full release of liability for the asset.

FINANCIAL IMPACT

Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost) as there are no costs involved with the transfer of San Bernardino County Fire Protection District (SBCFPD) surplus property to the San Bernardino County Sheriff/Coroner/Public Administrator’s Department (Sheriff’s Department).

 

BACKGROUND INFORMATION

SBCFPD assets identified in this item are fully depreciated, presently out of service, and no longer meet the needs of SBCFPD.  Therefore, SBCFPD recommends that these assets be declared surplus property (Recommendation Number 1.a.) and transferred to the Sheriff’s Department.

 

The Sheriff’s Department provides collaborative law enforcement solutions to meet the needs of the community and partners by delivering quality professional services to America's largest county in geography in the continental United States.  The Sheriff’s Department marine enforcement teams (marine teams) are instrumental in preventing criminal activity and providing public safety to the residents of San Bernardino County. The surplus property transferred to the Sheriff’s Department (Equipment Nos. 003012 and 035300) will be used to assist the marine teams and to support SBCFPD during water rescues and recovery.  This will be a benefit to County and SBCFPD residents, especially those residents who live in or travel to the surrounding areas near Lake Havasu.

 

Equipment Nos. 003012 and 035300 are recommended for transfer at no cost to the Sheriff’s Department, versus sale at auction or for scrap, based on the consideration being received by SBCFPD pursuant to the recommended agreement, as well as the benefits that the transfer of these assets will provide to County and SBCFPD residents.

 

Pursuant to the terms of the recommended agreement, SBCFPD will receive indemnity and a full release of liability for the assets.  SBCFPD and San Bernardino County are self-insured public entities and under the terms of the agreement, San Bernardino County waives its right of subrogation associated with the assets.  Transfer of title will be coordinated with the Fleet Management Department.
