FINANCIAL IMPACT

Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost) as the acceptance of the Certified Election Results is non-financial in nature, and appropriation for the minimal staffing required to present the results to the Board of Supervisors was included in the 2021-22 Registrar of Voters (ROV) budget.

 

Pursuant to Government Code section 57150(e), the County shall incur the expense of the August 31, 2021 Consolidated Mail Ballot Election, because voters rejected Measure X. ROV estimated the cost of this election would be about $68,000. A final accounting of the cost of this election will be completed by early January 2022.

 

BACKGROUND INFORMATION

On January 20, 2021, the Local Agency Formation Commission for San Bernardino County (LAFCO) considered and approved LAFCO 3244 - the Town of Apple Valley’s request for reorganization to annex approximately 1,424 acres into the town and detach the same territory from County Service Area 70. Due to the results of a subsequent protest proceeding, LAFCO determined that the matter was subject to confirmation by the 59 registered voters residing within the reorganization area and requested ROV to conduct the election.

 

ROV conducted the August 31, 2021 Consolidated Mail Ballot Election, in compliance with the California Elections and Government Codes, and County Code. The all-mail ballot election included one measure, Measure X, to determine if registered voters residing within the area subject to LAFCO 3244 wanted this area to be reorganized by being annexed into the Town of Apple Valley and being detached from County Service Area 70.

 

ROV hand counted the mail ballots and completed the canvass on September 10, 2021, 10 days following Election Day. Ballots were cast by 14 eligible voters in this election, which equated to a 23.73 percent turnout of all registered voters in the election.

 

On September 10, 2021, ROV certified the election results with 13 voters voting against the measure and one voter voting in favor of the measure. Since a majority of the voters voted against the reorganization (annexation and detachment), Measure X failed.
