RECOMMENDATION(S)
Recommendation
1. Approve non-financial Cal-Photo Agency Agreement with California Department of Justice for access to Cal-Photo by the Department of Child Support Services for a period not to exceed three years from the date of execution.
2. Authorize the Director of the Department of Child Support Services, as required by the California Department of Justice, to execute and submit all documents related to the Cal-Photo Agency Agreement, and any subsequent non-substantive amendments, on behalf of the County, subject to review by County Counsel.
3. Direct the Director of the Department of Child Support Services to transmit all documents and amendments in relation to the Cal-Photo Agency Agreement to the Clerk of the Board of Supervisors within 30 days of execution.

FINANCIAL IMPACT
The Cal-Photo Agency Agreement (Agreement) with the California Department of Justice (DOJ) is non-financial; therefore, it does not impact Discretionary General Funding (Net County Cost).
BACKGROUND INFORMATION
Approval of the recommended Agreement with the DOJ will allow the Department of Child Support Services (DCSS) continued access to Cal-Photo. Cal-Photo provides a quick and easy means of visual identification through access to mugshot images maintained by California’s law enforcement agencies, as well as a connection to the photographs maintained by the California Department of Motor Vehicles (DMV).
DCSS is required by federal regulation to establish and enforce child support orders and, therefore, has a business need to access Cal-Photo. DCSS utilizes Cal-Photo to confirm the identity of parties that are submitting to genetic testing to establish paternity; to confirm or deny cases of mistaken identity once a case has been established; to obtain locate information to assist in the establishment or collection of child support; and/or to assist the third party process server in identifying case participants that are evading service of legal documents to establish or collect child support.
DCSS currently has an Agreement with DOJ, which does not have a termination date. The DOJ requires all agency’s accessing Cal-Photo to file an updated Agreement at least every three years, when the head of the agency changes, or immediately upon request by the DOJ. The recommended Agreement allows DCSS to meet this requirement in addition to obtaining approval by the Board of Supervisors, as required by County Policy No. 11-06.
