Recommendation

Acting as the governing body of the San Bernardino County Fire Protection District, approve Amendment No. 1, retroactively effective on July 1, 2021, to Agreement No. 11-349 with the City of Loma Linda, extending the term of the agreement by 10 years, from July 1, 2021 through June 30, 2031, for a total contract period of July 1, 2011 through June 30, 2031, updating the service area identified in the agreement, and adding confidentiality provisions that will allow the City of Loma Linda to continue to provide fire protection services, including emergency medical response, for the San Bernardino County Fire Protection District in the service area identified in the agreement with no change to the annual compensation amount of $13,000.

FINANCIAL IMPACT

Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost).  Using funds available in the Valley Regional Service Zone, San Bernardino County Fire Protection District (SBCFPD) will continue to compensate the City of Loma Linda $13,000 per year for the subject services.  Revenue and appropriation pertaining to this agreement are included in SBCFPD’s 2021-22 budget and will be included in future recommended budgets. 

 

BACKGROUND INFORMATION

On June 7, 2011 (Item No. 85), SBCFPD Board of Directors (Board) approved Agreement No. 11-349 (Agreement) with the City of Loma Linda (City) for the City to provide fire, rescue, and emergency medical response to the service areas covered by the Agreement in the amount of $13,000 per year for the period of July 1, 2011 through June 30, 2021. 

 

Amendment No. 1 to the Agreement provides for uninterrupted services for an additional ten-year period retroactive to July 1, 2021 through June 30, 2031.  More specifically, the City will continue to provide fire protection services, including emergency medical response, to the County’s unincorporated areas located within the City's sphere of influence that are currently under the jurisdiction of SBCFPD. The amendment also updates the service area identified in the Agreement (the area is reduced from the original 2011 service area due to annexations into the City’s fire protection area) and adds confidentiality provisions. Although the service area is reduced, SBCFPD will continue to pay $13,000 per year as the City’s costs of providing services under the Agreement have increased.  All other terms and conditions of the Agreement will remain the same. 

 

Amendment No. 1 is retroactive to July 1, 2021 due to a delay in contract review and negotiations.  Any future amendments or new agreement with the City will be reviewed sufficiently in advance to avoid a potential lapse in service or the need for future retroactive Board action.
