RECOMMENDATION(S)

Recommendation

1.                     Approve Amendment No. 1 to Contract No. 20-947 with Satellite Tracking of People, LLC to provide Global Positioning System tracking services for the Probation Department, increasing the contract amount by $900,000, from $900,000 to an amount not to exceed $1,800,000, and exercising the option to extend the term for one additional year, for a total contract period of October 1, 2020 through December 31, 2022.

2.                     Approve Amendment No. 1 to Contract No. 20-948 with Satellite Tracking of People, LLC to provide Global Positioning System tracking services for the Sheriff/Coroner/Public Administrator, increasing the contract amount by $410,000, from $410,000 to an amount not to exceed $820,000, and exercising the option to extend the term for one additional year, for a total contract period of October 1, 2020 through December 31, 2022.

FINANCIAL IMPACT

Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). As a result of AB 1869, which eliminated a County’s ability to charge certain criminal fees, the 2021-22 State Budget includes $65 million in revenue to backfill counties for the loss of this fee revenue.  Therefore, it is anticipated that costs for these services will be funded by the State. Adequate appropriation of $900,000 and $410,000 for the provision of Global Positioning System (GPS) tracking services has been included in the 2021-22 budget for the Probation Department (Probation) and the Sheriff/Coroner/Public Administrator’s Department (Sheriff), respectively, and will be included in future recommended budgets.  Revenue was not included in the Department’s 2021-22 Adopted Budget, but will be included on a future countywide Quarterly Budget Report presented to the Board of Supervisors (Board) for approval once received, if necessary. 

 

BACKGROUND INFORMATION

GPS is a satellite navigation system that allows the user to accurately pinpoint geographic locations. For the past several years, Probation has used GPS tracking services as a supervision tool for a variety of offenders, including gang members and sex offenders. Additionally, Probation uses this technology as a form of house arrest for high-risk juvenile offenders, which reduces the cost to maintain them within the juvenile detention system. The Sheriff has been using GPS tracking services to better monitor minimum security inmates and low risk offenders eligible for placement in a home detention program, in accordance with California Penal Code Section 1203.016.

 

On September 29, 2020 (Item No. 39), the Board approved Contracts No. 20-947 and No. 20-948 with Satellite Tracking of People (STOP), LLC for GPS tracking services in the not to exceed amount of $900,000 (Probation) and $410,000 (Sheriff) for the period of October 1, 2020 through December 31, 2021, with the option to extend the term for one additional year.

 

PROCUREMENT

Probation and Sheriff negotiated the existing contracts for the period of October 1, 2020 through December 31, 2021 based on a competitive procurement process conducted in October 2012 by the National Association of State Procurement Officers (NASPO). The NASPO agreement had an original effective period of May 1, 2013 through December 31, 2021. On July 1, 2021, the NASPO agreement with STOP was extended through May 31, 2023.

 

The recommended amendments will extend the Probation and Sheriff contracts with STOP, LLC through December 31, 2022, following the extension of the NASPO agreement described above. The County Purchasing Department supports this request.

 

Probation and Sheriff will conduct a competitive procurement process in 2022 to ensure new contracts are in place by January 1, 2023.
