Recommendation
Approve Cooperative Agreement with the City of Montclair to widen and/or reconstruct Central Avenue including the bridge over the Union Pacific Railroad in the Montclair area, effective upon execution by both parties through December 31, 2026 or upon project completion, whichever occurs first.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The Department of Public Works (Department) is funded by Gas Tax revenue, fee revenue, and other federal, state, and local funding. The City of Montclair (City) will fund the Central Avenue Improvement project, between Mission Boulevard and Holt Boulevard (Project), with the exception of San Bernardino County (County) staff labor costs, which involves reviewing the Project plans, right-of-way documents, attending meetings, and other coordination as necessary. The estimated total cost for the Project is $30.2 million which will be funded by the City; and the estimated County labor costs of $100,000 will be funded with the Department’s Gas Tax revenue. Sufficient appropriation and revenue are included in the Department’s 2021-22 Road Operations budget, and will be included in future recommended budgets (6650002000 22H151525).
BACKGROUND INFORMATION
The City intends to widen the roadway and reconstruct the bridge on Central Avenue in the City’s jurisdiction and desires to include the southerly approach of the bridge on Central Avenue towards Mission Boulevard which is within the County’s jurisdiction as part of the Project. The City is requesting the County’s participation in the Project to streamline the design, environmental compliance, right-of-way acquisition, and construction. All costs associated with the Project will be funded by the City with the exception of County’s labor cost for the review of Project documents and other coordination as needed for the Project.
Execution of the Cooperative Agreement allows the County to meet its goals and objectives by working cooperatively with the City in the City’s effort of improving the traffic movement along Central Avenue.
Pursuant to the proposed Cooperative Agreement, the City will serve as the lead agency for the Project, including right-of-way services (temporary construction easements, permits, etc.) within the County’s jurisdiction. Pursuant to Streets and Highways Code section 1710, Code of Civil Procedure section 1240.140 and Section 6500 of the Government Code, the parties may enter into an agreement for the joint exercise of their respective powers of eminent domain for the acquisition of property. Approval of this Cooperative Agreement will allow the City to exercise the power of eminent domain on the County’s behalf to obtain property necessary for the Project, if later determined to be required. The County shall provide a representative to review the plans and specifications, and discuss other concerns that may arise during the Project. After the City’s and County’s acceptance of the completed Project, the County and City shall be responsible for performing maintenance of the road located within their respective jurisdictions, with the exception of the approach located south of the bridge in the County’s boundaries, of which the City proposes to operate and maintain in accordance with the City’s regulations, policies, and procedures. A separate maintenance agreement, for the bridge structure from and including the abutment to abutment, between the parties will be presented to the Board of Supervisors for consideration at a later date.
The subject Cooperative Agreement shall terminate upon the Project completion or on December 31, 2026, whichever occurs first. Project construction is anticipated to commence in the Spring of 2023 and will take approximately two years to complete. The City approved this Cooperative Agreement on October 18, 2021.
